Heres a scenerio someone asked me and whats yours thoughts....

I have to fill a W9 form out and I have an LLC ownership...IE NSA Properties, LLC. The LLC is a 2 member LLC of which the members are husband and wife. Do I fill out the Name as NSA Properites, LLC and the business name/dba leave blank since I am going by the same name? Also do I check individual/sole prop., corporation, or partnership and check other and write in LLC?

My answer was that in the eyes of the IRS husband and wife in this case are viewed as one in the same and since the LLC is going to taxed as an individual not a Corporation (also LL"C" Company not "corporation as most mistaken it for) check individual/soleproperietor and Check the "other" box as well and write in LLC. I also told the individual who is friend to check with their attorney/accountant.

Any thoughts? She was basically asking for just general ifnormation but then i started thinking it over and over and over again and well we all know what happens then.. Things get mushed together.

"Limited Liabilitay company (LLC). If you are a single-member LLC(including a foreign LLC with a domestic owner) that is disregarded as an entity separate from its owner under Treasury regulations section 301.7701-3, enter the owner's name on the "Name" line. Enter the LLC's name on the "Business name" line. Check the appropriate box for your filing status (sole proprietor, corporation, etc.), then check the box "Other" and enter "LLC" in the space provided."
