Well, it had to happen eventually ... but this is my first payment issue. Check was returned to me stamped "Closed Account" by their bank, and labeled as NSF by mine.

Take it to your local police dept and let them know they are writing bad checks. You won't get paid but the police dept will take some sort of action on it.

Start with a demand letter

Start with a demand letter requesting the principal of the check, nsf fee (normally between 25-35 dollars) and certified mail fee. Give a deadline date of 10-15 days (do not say business days)

Send the letter certified mail and then mail another copy regular mail. (due diligence)

All depending on what county you live in, you may be able to get the local prosecutor involved.

If this is not a good route for you, you may be able to start small claims litigation.

I love the way BradCA is always putting links to info.

I beat him... looked up the county (Orange) and the DA... website didn't have much but a quick phone call got pay dirt.

www.orangecountyda.com (click economic crimes, but not much info there)

But there wasn't much info so I called and they gave me the

OC DA's Bad Check program: 800-931-9352


In CA we love bad checks, because they fund local government. The DA will arrest them (no handcuffs, but mug shot and a record) add treble damages, collect at their bank or mailbox if needed, send you your money (maybe with a little extra) and keep the treble part.

What an incredibly nice thing to do - THANK YOU, GARY

I'll call the OC/DA when they open and ask their opinion on how to proceed. I was so stewed over this, but couldn't pursue it much yesterday. I did manage to reach someone saying they were "in charge of the accounting", and they said to send it back and they'd send another check (NOT apologetic, the attitude was less than fuzzy). I'm thinking I should retain this first check - but if OC DA says a copy would suffice for my purposes, then ok. I don't see what purpose they have in wanting it returned to them OTHER than to remove it from MY posession. I'll find out.

SO ironic, as I was just spewing off to another SA yesterday about how I've "never had a payment issue" and I don't much think about it, but I DID say it was likely just a matter of time. Still ... it is only one time, and it's also still possibly resolvable. What really fries my cookies is that it was off a Closed Account. Maybe I'm lacking understanding, but it just seems more likely to be intentional. If/When resolved, I will certainly post.
