I just read the heated discussion

that many of you had with Victoria/NJ and I just have to say I felt as exhasperated as you all probably did. It is just silly and aggravating to try to explain something to someone who just doesn't get it- and to make it worse, teaches their ignorance to others (or tries to) What a shame. BUT on the other hand, other notaries in NJ will be busier because of her...
I recently had to work with an apartment manager who didn't get it and when the property sold, she was no longer there and I received a large bonus for keeping things together in spite of her so that the sale would happen, so people like that aren't all bad.

I maybe wrong, but I kinda get where her arguement came from. She's just probably trying to lump together what we do with the typical 9-5 in office closing where everything has to be in compliance. She may has been more involved with what went on behind the scene (the insider) with lender's processors/underwriters about those "date" compliance stuff that none of us give squash about.

All we care is set the appointment and make our customer happy by getting those docs signed-notarized correctly on the day/time they requested. Everything else doesn't matter.

People need to remember to differentiate from what is law, what is locally commonplace or SPECIFIC to a particular market/company/area, and what is something they might have learned and held as true but that might have changed and they may have missed that change.

Some lenders might not allow a transaction dated for Sunday, SOME DO - this is part of the change affected by the now-common use of SA's, and non-date-sensitive docs. MANY years ago, this would've been unheard of. Changes can slip by you - sometimes it's relative to how tightly you clutch your list of "Things I Know".

I suspect that on that list for a particular person is the sentence "A loan can never FUND on a Sunday or Fed. Holiday." (This is not a LAW, but a practice - investors do not like the smell of anything improper, and funding on a day when the banks are closed MIGHT HINT at funding early.)

The scariest part of her arguement is that she is

very experienced with over 10,000 loans, teaches classes, but yet has not even the most basic understanding of the Federal Statues regarding the 3 day RTC period. Good for other NJ notaries in her area though:-) Hopefully old dogs can learn new tricks....
