Not getting paid
Hi, I am 7 months new to the business and several of the companies I worked for have not paid me yet. I followed the payment instructions, but one company doesn't return my calls or is never there...another has not been paid by the lender and therefore hasn't paid me...and still another I could not get into their payment link on the email so uh, yeah, I bugged them too and they have not paid either!! Has anyone had to threaten small claims court? This is ridiculous! I have even sent invoices. Please advise

I have had a problem with 1 particular company but not several. Try NNA they have suggestions and companies that can help you get paid

It might help to tell them you are going to make a complaint about them to the title company and or to the lender. Also tell them you will expose them on the internet, they dont want their customers to know how they are mis-handling things.

This might sound terrible but I had a ss owe me almost $600 that they kept promising to send everyday. They left out a doc from one of their closings that I did for them and they sent me back out to have it signed. I reluctantly went back to the borrowers house (only about 8 miles away) the document was a name aff. My husband suggested that I hold the name aff till they sent a check. They told me that it was against the law to not send the document as it did not belong to me. When I asked why I couldn't get paid you wouldn't beleive the response I got. I was told the title agencies paid them for the closings that I did but they spent all the money!!!! My contact at the ss said they would need to get some new clients before they could pay me!!!! I said well I guess this document is going into the shredder. The ss stalked me by phone and email and I blocked them from calling and emailing me. After this happened I found out on notary rotary that they don't pay. I contacted all the local notaries by email and told them to beware of this company. I told the ss before I blocked their calls and email that they were known on the internet as non-payers. My contact said we will sue for slander if they are saying that. She said we might take 3-4 months to pay our notaries but we eventually do pay them. I told her that I was told that she would pay me in 30 days and she said well we lied!!! She mailed me a check for $150 and I told her it wasn't enough and I shredded the name aff.

Your post pretty much astounded me. First and foremost, never let someone get into you for that much money! Since you did AND you accepted another assignment, it is in fact a big no no to hold documents hostage for payment. This has a direct reflection on the innocent borrower who may not have their loan funded, this borrower did nothing to deserve this type of treatment. You have to accept part of the responsibility for getting in so deep with the SS, to hold the docs and then shred them (even if it was just one) is totally unprofessional in my opinion and you should have checked out this company FIRST before allowing $600 in unpaid invoices. IF you cashed that $150 check the SS sent you you are in fact liable (I would think) because they took the necessary steps to mitigate the issue and by cashing the check you accepted their terms. To say "nope not enough" and shred Title's docs without authorization is begging for trouble. You've caused problems that could be financial to the borrowers who are totally innocent in this transaction. Shame on you! IMHO

It's hillbillies like you that make me want to move up north. To many of you hicks around here. The ss company went out of business. (The owner of the signing service drove to the borrower's home and had the name aff signed) borrower's were not hurt by my actions. SS told me they would handel it themselves.

Notaries --- DO NOT EVER hold or intentionally destroy documents. This moron is lucky she's not sitting in court right now....Very lucky. I hope you have tons of E&O insurance, you'll need it sooner than later, with your knowledge or lack there of, of notary law, morals, ethics, professionalism and the brain power to figure out how to run your business legally.

If the SS sees your post on a public forum admitting that you've shredded a document, YOU could be sued.
As for non-trashy people in CT, there are those types everywhere.
You're an independent contractor and you take the risk of non-payment every time you do business with a company. It's inherent.
As for the SS "stalking you" they were trying to make sure you upheld your end of the deal in getting that document signed & back to title. The job wasn't completed in full. IMO, you shouldn't be paid.
The attitude doesn't help, either.

When you are contacted for a signing always try to get as much information about the ss as possible. Do a search on this board to determine their payment history. Always ask the ss what their turn around time for payment is. Always have them mention both the amount of your fee and the payment date in the confirmation. The confirmation memorializes the understanding of the services expected and the payment expected. If they fail to deliver..do not hestitate to seek legal redress.
Unless your payment was conditioned on your client's being paid first, that is not an excuse for not paying you in a timely manner

I had numerous confirmations with the payment terms and my fee listed on the confirmations. How do you take a company to small claims court when they went out of business? I'm thinking about moving to CT. I'm really sick of the white trash people in this area. I have friends and family in CT and they are so different then here. Really good people up there. More educated, friendly folks up north.

I felt for you about the pay issue. It's not right not to get paid, but shredding a document is WRONG! As for the Trashy people, I have meet good and bad people all over this country, in the North/South/East/West and here near the middle. To make a comment like you did makes me wish I could help you move, very, very far away!!! Like maybe to IRAQI !

No problem taking them to court even after their out of business... if it's a sole proprietorship (probably is) The problem is converting a judgement to cash.
Of course if they can prove to the judge that you notarized a document then destroyed it that's not gonna help you much.
