Now taking bets...

Ok before you shoot me, I was bored!! That's my excuse, I swear! I just recieved a call from the infamous SOX. They want me to do a signing in an hour, and the signing is 30 mins from me. She said the docs *might* be ready on time. I said.. "I'll do it, but I will ONLY do it if the docs are ready on time" I have yet to recieve the confirmation letter on this. I'm taking bets.. will I get the docs on time? I won't even attempt to start betting on wether I will get paid or not, lol.

Oh! I got the confirmation... with the wrong fee quoted! I emailed back, repeating the fee I quoted them. It also said I would recieve docs "within the hour" ...I need the docs by 4:45 in order to arrive on time at the borrowers.. we shall see.

NO docs by 5 after 5, I emailed, explained that I would not be able to print and get to the borrower by 5:30 appointment time. No response. Well, we all needed a good chuckle, right?

I'm shocked that there haven't been a few bleeding heart "but think of the borrowers!" posts in this thread. I like your style.

Now tell me, what would you have done if the docs did turn up on time? Surely you woulnt' have been foolish enough to actually do a SOX signing?

Foolish enough that I told them I would reschedule for 8pm if they paid me an extra $25...like I was ever going to get paid the first fee, lol.. oh well. Now we have the problem that the person's birthdate is completely wrong on the forms... (she is NOT 86 years old). How can I verify an identity if the birthdate on the forms don't match the birthdate on her driver's license? SOX's advice? "Have her cross out the birthdate and write in the correct one" Luckily, the loan company had a brain.. they are fixing it and mailing me new copies of the pages with her birthdate.

1. Don't come whining on this board about SOX not paying you 3 months from now. Anyone who reads this board and still goes and does signings for them deserves to be stiffed. You are a fool.


2. Where in your notary law does it say that the birthdate on the ID has to match the birthdate on the forms? You only look at the ID for notarization purposes, everything else is irrelevant.

Now switching to your signing agent hat, sure, it was good of you to bring the discrepancy to their attention, but I really don't see anything wrong with crossing out the birthdate and initialling the correction, that's the type of clerical error that's covered by the correction agreement in the docs.

Well 1. I wouldn't come and whine.. hense my post right now, I am calling *myself* a fool.. not whining that I am not going to get paid - I'm joking about it.
And 2. The loan officer agreed with me that he too would not feel comfortable notarizing documents with the incorrect brithdate on them - that there is a possibility of forgery if you don't have ID that matches the information and you are only setting yourself up later. They were quite happy to correct the docs and send them on their way.

Why are you joking about it? Don't you take running your business seriously? Knowing what you obviously know about SOX, why on earth would you agree to do a signing for them?

As long as they keep finding chumps who can find reasons to convince themselves to work for SOX, they're never going to change their habits. By accepting this signing you're doing a disservice to the entire signing agent community. You should be so proud of yourself, what a funny joke indeed.

I know that I run the risk of not getting paid by them because of so many posts here. I also know that I *HAVE* recieved a check from them for a signing that I did for them in the past which is why I decided to roll the dice this time. Yes, their billing methods seem to be set up for the notary to fail to recieve their money, but I think that since I was so proactive the last time, that is why I was paid. I hope to be as proactive this time and be paid for this signing as well. I feel it is a joke since so many have been burned by them, and they are the butt of many a joke on here.

No kidding. It's amazing what greed by desperate signing agents will allow them to accomplish. And it's really sad that people like Barbara don't have the principles to tell them where to stick their signing because it wasn't HER that didn't get paid, it was only hundreds of OTHER people who were screwed by SOX.

Any company who routinely screws over signing agents is a company that isn't worthy of any of our services, period.

Make sure

you keep a copy of the docs in a secure folder on your computer until you are paid!! I'd also make a photo copy of the signed HUD with all the title company information on it.

I don't understand you wanting to take the job, but I sure will not do anymore signings for SOX. Given one of my first signings was for them and you have been paid before by them - it only makes sense to see that they look for newbies and people who have bugged and got paid. No time for buggin here and I'm not a newbie anymore Smile

Think it was more a case of identification - the ID and the docs had 2 different birthdates, thereby raising the question of accurate identity.

Some of the Statement of Identification forms ...

... have the borrower swearing to the data (supposedly) copied from the ID. The NSA then notarizes the borrower's signature on the form.
