What would you do?

A week ago I wrote a rather lengthy message regarding a signing I'd received and completed through a SS. This loan was a real problem child and I had to go out twice because of all the changes in the contents of the package. When it was completed I submitted a statement to the SS with an extra $50 for the second trip. I've heard nothing from them.

Yesterday I received a call directly from the title company telling me that the borrower had cancelled the first loan (she didn't like the terms) and they now had a new package they wanted me to take to her. They were sending it over night via FedEx. I immediately called the SS and told them the situation and that I would need another confirmation for a new signing fee. I was told by the person who answered the phone that they did not have the authorization to do that. I then asked if I could speak to the owner and was told she wasn't there, but would call me back.

Well, I haven't heard from her. The package will be here this morning or early afternoon. I woudln't hold up the signing because I don't think it's ethical to make a borrower suffer for our mistakes/greed. We're suppose to be professionals. But, I honestly don't know how to approach this SS.

If I was contacted directly by the TC then I would request a confirmation from them. Regarding the second visit, I would have requested a confirmation B4 completing the asignment. JMHO!

If the title company is booking directly with you, I would ask them what the fee is.. If it is ok, do the signing. The ss booked you for first loan.

Yes, if the SS is playing dumb, just ask a confirmation letter from title, and charge title prices. Forget the SS!

I would have refused to do the signing. It is not our problem what the borrower's situation is. We are not non-profit. We are in an actual business and we should be paid for our work period.

I would definably deal with title. They called you and the SS knew nothing about it and wasn't even helpful when you tried to give it back to them. Their loss your gain. Bill title.

If you do not have a confirmation from either TC or SS, do not even think about completing the signing.

Contact the TC, discuss payment with them, and then have them email or fax you a confirmation.

When a company sends you docs without a confirmation, it is not your problem, and you shouldn't feel that you need to get the docs signed. If the TC or SS wants the docs signed, they'll send you a confirmation.

NO, NO, NO!

Once we have agreed to do the signing and the docs are received we MUST do the signing! See previous threads.

Once we have accepted, it's a done deal UNLESS we find out via the confirmation that the caller lied to us (such as SOX claiming to be some other company).

Never, ever put the borrower's loan at risk. Ever.

Actually, that's incorrect. The confirmation is the contract that states you will complete the signing and how much you will be compensated, along with other instructions.

If you have nothing in writing, stating that you are supposed to complete the signing, then there is no deal. If you receive a confirmation that does not reflect the agreed upon fee, then the signing shouldn't happen until you receive a corrected one.

I am sent docs all the time, for things that I've never agreed to. Nor do I have any written confirmation. I call the company that sent them (# listed on label) and let them know that the docs will be sent back to them.

If they want to hire me to complete the signing, that's fine, send a confirmation in writing. This is a business, not Romper Room. If a company wants their signing completed, they will send a confirmation.

I had a similar situation awhile back. The LO called me direct and asked if I could resign a loan I had closed for a SS. He explained it was a redraw and there wasn't enough $$ available for the SS fee. He wanted to know if I would do it for $xxx. You bet I would! It was more than the SS was paying me (for the original signing) and I received the check immediately. Take the job.

Good News!

Just got a call from the title company and explained the situation. They said they would pay the SS for the first signing (so they can pay me), but this new signing is mine along with a very good fee!!
