Federal Day of Mourning and Rescission Dates
Since this does not come up very often...
Does President Bush's declaration of 1/3/07 as a federal day of mourning for the late Presisdent Ford affect rescission dates? All federal offices will be closed that day. Just curious. My gut tells me no, but I thought I'd check around, just to be on the safe side.

It is my understanding that the federal holiday for the purposes of calculating the recession period in federal law are too set by federal law (5 USC Section 6103) “Holidays (a) 1. The following are legal public holidays: New Year's Day, January 1. Birthday of Martin Luther King, Jr., the third Monday in January. Washington's Birthday, the third Monday in February. Memorial Day, the last Monday in May. Independence Day, July 4. Labor Day, the first Monday in September. Columbus Day, the second Monday in October. Veterans Day, November 11. Thanksgiving Day, the fourth Thursday in November. Christmas Day, December 25.” Thus, it seems that the recession period is calculated based on these “legal public holidays” enacted by Congress. I think that a presidential declaration as to a “day of mourning” only affects federal agencies directly under the control of the executive and not private businesses such as mortgage lenders, malls, etc. I hope this helps.
