ID"S NOT included ... help please
Hi everyone. I did a closing on Saturday am. I was to include the copies of ID"S . Borrowers did not have them. I called after hours # , and told them, since fedex won't pick up until monday, can they fax them to me, I will then fax to you, and include in package before shipping. As of Saturday 5pm, I left another message at their home, to remind them that I needed the copies. I have no response as of 10 am Sunday morning. So, if they don't get them to me , where is my liability? I did sign an affidavit , which I will remove that I included their id's because I don't have them. I told them the loan depends on this. Mrs. X may be using that to her advantage because she seemed unsure about the whole thing. At what point should I just say " enough" and drop the package and let them deal with the situation on their own?.....

In some of the packages I have done, sometimes it states that if the borrowers dont have copies of ID's at the time of the signing they can always fax them the following day or within the RTC period.

I think you have done enough already. I would not hold a package for the lack of ID copies. I would just remind the borrowers that they need to get in and advise whoever hired me of this. If I have the package when I call to confirm, and copies are required, I remind the borrowers of this. If they don't have copies then I will usually take a digital picture of them with either a small camera I usually carry or with my cell phone. These can be printed quite quickly and included with the package if there is time before last drop off. I would not delay the package for this. I would just do as you have and advise both the borrowers and title.

all times, I have a camera on my cell also but have found the quality for DL pics are poor, at least on mine. I actually learned this lesson the hard way when I was new. I was to get copies of the borrowers DL, I neglected to do this (no one's fault but my own) the lender would take nothing less, I had to drag my sorry you know what back(and this was when I accepted work a distance away), collect the DL, take them to be copied, drive them back to the borrowers(oh by the way this was in the middle of nowhere). Borrowers did not have a copier. The fee was a good fee but by the time I was done I paid them for the signing, it was absurd but I learned a great deal from that signing.....Life lessons....the great thing, the borrowers were the nicest folks so if nothing else I shared a brief moment of time with two really nice people, the wife was just recovering from a stroke, the hubby was totally devoted, they lived on a large piece of land, private......they had wonderful animals so it was fine in the end. PS-I would never hold docs unless the hiring party instructed me to. One of the best moments of a signing in my mind, is dropping th docs....whew done.....all right....especially when roads are icy,weather is rainy or fog has moved in.....

ion call time that I need a copy of their ID to include in the package. I do the closing, do the ID thing for my journal...if they DON'T have the required copy, I advise them AGAIN of the need to fax it to their LO or EO and I place a sticky note on the paperwork advising them of this fact. I then drop the package. End of story. It is not MY place to babysit the borrowers. They are adults and if they want this loan, they will comply with the required information. I did a loan the other day where they were required to bring funds (certified) to the table. He did not have it and I was unable to contact the office. SO, I advised him that I would return the next day (which was a Saturday...my Sabbath...usually don't work) meet his "wife" at the bank and pickup the check. Well, you know the story. No wife showed up...no check. Dropped the package with a letter of explanation from me. Four days later, the services calls. Wants me to go BACK to this borrower to do a resign. (probably due to the check thing AND the fact that he was listed as an unmarried man...but had 3 children and a wife). I refused. My job is to have the papers signed, verify identity, answer questions (within the scope of my expertise) and that's it. I do not babysit borrowers, and do not go back to them for something they were told they needed. As you stated, by the time you got done, you paid THEM for the signing. IMHO...not worth it. "Doc" (the real Signing Doc...by trademark in 50 states....be advised "NotaryDoc" )

Thank you...A nice Jewish boy...singing in a Holiday Concert with the Las Vegas Philharmonic last night and today. Wonderful Hanukkah songs like....Silent Night...Jingle Bells, Carol of the Bells...Joy to the World (Oy to the World)...:-) Just teasing...the orchestra did do a marvelous rendition of a Chanukah Medley. Next week we will put up the Hanukkah bush (blue and white)...and wait for "Hanukkah Harry" to bring gelt and chazerai to the kindele...(money and junk to the children)...Hanukkah Harry is Santa Claus' Jewish brother (the one no one talks about)...LOL Be careful up there in the land of the ice and snow (Is Santas Village still in operation up there?...I'm a SoCal Native and we used to go up there about this time of year)

Get that tin foiled star with blue lights up, mine is. Santa's Village is no more, it is currently filled with thousands of trees, they have been cutting down for some time, they drop them there and then trucks come to collect them and haul them down the mountain. My kiddos now in their 20's also remember the Santa's Village of then. I had a signing in Running Springs Friday and passed by Santa's Village......before they begin using it as a loggoing station, they were holding concerts there and will again once the logging is complete. The scent of pine is wonderful as you pass by there on highway 18.

at first I thought you meant the one in the Santa Cruz mountains... we went by it every week on the way to our beach property and begged to go in prob every time....but dad always said nope we are Jewish...
it shut down years ago and housing tract now....

I am with you on this one. I don't tolerate any nonsense-PERIOD! When I accept a job I ask for any instructions they want me to follow. I also read the confirmations very carefully. If the borrowers need copies of their ID I inform them at the time I confirm the appointment with them. If they don't have it when I get there I explain to them that their loan my not close/fund with out it. (I have several digital cameras but I am not about to start taking pictures of DL with any of them) I put a note on the package and that is that. I am not a babysitter! If the borrowers don't care enough to get what is needed and I have told them well in advance then why should we care?! Now if they have a disability or have a transportation problem I will take care of it.

Thanks everyone !! I did exactly that.. I was told all is ok. Unfortunatly, I live in an area where people can be shall we say ... not too bright. I just needed some insight because there were many mitigating factors and I didn't want to jepordize my fee. It's on them either way. As long as my tush is covered.

I'm with you, Carmen ...
The LAST thing I want is a photograph of someone's D/L - and for that person to have THAT be the first thing to come to their mind, should they become a victim of ID Theft. It's enough responsibility for me to secure the integrity of my security procedures for my cpu. I don't know jack about securing data held on a mobile phone/camara, but I do know one way to make sure I don't NEED to.

That's a good argument against the practice, however, the info is online in databases such as PublicData.com...for Texas, anyhow. I'll keep doing it when it's needed.

It is the borrower's responsibility to have copies of ID if needed. If they do, I don't even look at them, just put them in the package to be returned. I look at the original ID only. I also complete a "Visual Verification of Identification" form (available on my website) and supply that to the title company whenever copies of ID's are requested, but not available. In most cases, the title company and/or lender has been satisfied with the use of the form in lieu of receiving copies of the ID.
Further, the new Florida driver's licenses are somewhat difficult to copy. 90% or more of the time, the copies I get from the borrowers are basically worthless, imo, and very difficult to read. And faxed copies are even worse.
When making copies, it's a good idea to increase the size of the copy by at least 25% and copy only in black & white. A few title companies with which I work consistently, have policies about copying the identification, which states that they must be enlarged to at least 125% of the original size and not in color.

Way too easy and not....
a problem to snap a digital picture. I always have my camra with me and consider it part of my commitment to provide a complete error free signing for my clients.

I always have a camera with me anyway, I love to photograph that perfect sunset, an unusal situation.....I often snap random photos if for nothing else but cards.... It is also not a matter of being a babysitter to borrowers, or putting up with anything. It is a matter of being well prepared for any situation, heavens a borrower could have forgotten to photo copy, they may have run out of paper, the copier could be on the blink and not know it until the last minute. I consider no part of my position as a notary to be putting up with anything, except when it comes to payment issues..... I just prefer to be prepared for the unexpected......

I agree with the camera carry along crew.
When I started this business, I planned to make everything within my control go off without a hitch...some things can be controlled like...
Be prepared with plenty of toner/paper on hand.
Get to appointments on time.
Use a camera to have a copy of the ID.
Have an alternative means for internet download

I Consider Having a Digital Camera...
...as "insurance" for those instances where either the borrowers don't completely follow instructions or something happens outside of the borrowers' control which prevents them from making a copy of their DL's. It's just one more service a signing agent can provide (for minimal effort & cost) to set oneself apart from the crowd.

I purchased a color printer/copier from Office Depot for $50.00 (after $30.00 rebate) along with an adapter for my cigarette lighter and put them in my car (along with paper - and I put it all in a box). So, now when this happens I am ready for it. Works like a charm especially in Florida where the driver's licenses have changed and a black and white copy no longer shows the pertinent information because the copy is too dark (we have some really, really "odd" driver's licenses). Just offering a suggestion.

I had find that a good digital camera had helped me a lot in many situation. digital cameras comes on key chains, so my be this is a good holiday gift for yourself.
