hi, i'm in cali and i have this friend at work that moved from texas yr ago and was telling me all she had to do to become a notary in texas was send a check and then the mailed her stamp and everything and she was a notary....well she just told me how she left her stamp in texas at her job when she quit....that doesn't seem very safe....i know here in california we have to mail our stamp back to the county clerks office. is this normal in texas or should she try to get her stamp so people aren't running around with it in texas while she's here living in California. and how long does a tx commission last for?

You're friend can get great info. off of the Texas SOS website. Since she can no longer use her stamp, she should have gotten rid of it and not left it at her office. Our commissions last (4) four years. http://www.sos.state.tx.us/siteindex.shtml

As for change in address (out of state):

If notary moves out of state, they vacate the office of notary (resignation). The procedure for resignation is the notary must deliver the journal(s) and public papers to the County Clerk in which notary resides in or did reside in. They are to contact the SOS within 10 days of resignation by certified mail and the NNA recommends to destroy the notary seal.

La Homa - it is a four year commission. Tell her to go to the Texas SOS website and look for the notary link. I would give it to you but I am using my son's computer and have no mouse!!! (NO MOUSE? What mean trick to play on me...anyhow...I need to leave and go where there will be no computer and I wanted to answer asap.)

She needs to follow the instructions about moving away. Tell her at MINIMUM call the SOS in Tx with that info (that she's moved) just to make the effort.

She should call the SOS and ask what to do with her journal if that info is not easily located in that link above...I think that might be in the govt code. Our rules are sparse but you can get what is not there from the SOS.
