I'm BLOWN away! Never expected this...
I just received, in the mail, a check from the PIMA County Attorney...seems Miss Lisa Schreiber from our favorite Signature One is paying restitution on all the bad checks she has written. Granted, it is only about 1/2 of what we were out after the check she wrote bounced in our account. But, as my Dad always says, "It's better than a jab in the eye with a sharp stick"! LOL.
Just goes to show, that persuing those who do not pay, or those who write rubber checks, can pay off.

I take all checks that do not clear the bank directly to the DA's office. It's bad enough some of these lowball scumbags want us to do their signings for $50, but when the checks bounce Thats it, time for payback. And they will either payup or face jail time.

If I get a rubber check then I simply have my attorney write a letter to the person/business. We also demand damages in addition to the bank fee for non-acceptance.
If I were to be paid $125.00, and they send me a rubber check, they'd be paying me $150.00. Sometimes it's good to have an attorney on your side.

I see no point in retaining an attorney solely for my business as an ISA. The check fraud division at the county DA's office can do it cheaper and thats what they are there for.
In Oklahoma, I can legally charge up to $50 for insufficient funds, that does not include what the bank charges me or the $102 dollars they will pay in fines for writing the check in the first place.
That $125 dollar bounced check could very well cost them up to $300.00 and even more if the company is out of state.

Wow! I'm packin' my bags and moving to OK....
I thought my attorney's penalties were stiff!!
I actually didn't retain an attorney, I work with one (a couple actually) and am given the privilege of free legal services.
I've never looked into whether or not I'm suppose to report rubber checks to the DA or other agency/department in my State (Commonwealth). I'll definitely look into that because it would be good to know.
