Notarial Protest & Ameriquest...

I thought I'd share this with you. Yesterday a person called me asking if I do notary protests. I told him that I am somewhat familiar with the process and that I could not give legal advice. Due to the fact that I am not an attorney, I told him that I felt uncomfortable doing the protest.

It turns out that the person was an attorney and only needed a notary public to notarize the affidavits he had drawn up on his own. Given this, I agreed to notarize the documents he had. When the guy arrived I asked to see his bar card. I wanted to make sure he was legit. Thankfully, he was.

It turns out that the attorney is trying to null and void a contract he has with Ameriquest. What I don't understand is that the Massachusetts Attorney General, as well as numerous other states, have filed a lawsuit against Ameriquest. Wouldn't the lawsuits possibly bankrupt Ameriquest thereby deleting the need to pursue any type of protest, etc.?

Why would the attorney need a protest to cancel an unfair contract?

My best quess is Law Suits. He is protecting himself against (possiibly) being sued.

While I don't know anything about the specifics of this case, lawsuits of this type can drag on for years and years and years, and there is no guarantee that Ameriquest will even lose. If makes complete sense for this attorney to take his own course of action.

You must've missed the news...

Ameriquest just recently settled a $350 million dollar lawsuit, affecting their business and attorney's general in 49 states....

And they are far from bankrupt....still clicking ahead.

Not sure what it could be, as all of the states have pretty much signed off against further action against them thru last week? or the week before is when it was settled.

WOW! I must have missed that!! Smiley I wonder if notaries find their company to be good. I've never been called by Ameriquest, so I don't have an opinion.

Ameriquest has money!

They just paid a couple of million for a 30 second commercial spot.... they got money!
