Question 2 ID Problems

This is almost funny as LisaWI told me about a similar signing where the wife had a DL in her maiden name just the other day
Wife had a license with her married name but it was revoked (as in no longer in her possession). She produced her old license with her maiden name, which was expired and had the wrong address. Showed me her checks which had her married name and current (revoked) license. So I asked...do you by chance have your marriage license. ....Pause...."Yes! In our safe!" and the husband disappears. we wait....and wait. Husband comes back He can't remember the combination. They both disappear. And I wait. I call the lender as the ss is closed. He tells me all this is fine.She comes back and then a few minutes later he does...with the marriage certificate. The Lender calls back all excited and says I am to ask her questions like Birth date, SS# etc. Well its her birthday today and there's a birthday cake sitting there that can't be eaten until I leave so I ask how old that makes her etc. and on and on.
My question is was all this adequate Id (old license , check and marriage license, birthday cake)?

Lender's requirements for ID is not the same as the state's requirements. The lender can use all kinds of information to verify name, address, social security number, etc. need for the loan documents. However, only your state can dictate what forms of ID are acceptable for the notarization of a signature on any document, including a loan document. Remember, there are two processes at work: (1) loan signing and (2) notarizing signatures. These two dynamic processes are separate and distinct in their function, but must work together to make the overall process complete.

In other words the Lender probably doesnt care how you ID for notary purposes. As far as they are concerned, we should already have that taken care of, and we should.

Zana, Im going to try and write up a letter today on this subject. Did you have any luck with anyone responding to your post the other day? Its time to kick this into gear. Also if you are interested, there is a Seminar at the Stevens Point Expo on Fraud Prevention and Identity Theft and I am going. I wanted to see if they mention notaries at all.

Something else that bothers me, I did a signing last week and the gentleman has a passport. Well on his passport, he has SR, but not on DL. I asked him how they came up with SR. He said he just told them to. I asked him if they ID'd him. He said no. Is this possible or right?? When they do a passport for someone, dont they ID the person??

And to PAW: This is exactly why Zana and I are going trying to get more notaries involved in Wisconsin on this subject. Our statutes dont dictate to us what we are to use in addition to the primary photo ID. As a matter of fact, they say to use 2 photo ID's in a round about way (in a little notary skit) which in my opinion is just unrealistic. If you have any suggestions for us, we would appreciate it.

I've never heard of applying for a US passport without all kinds of valid ID. As for getting the "SR" on the passport, I've seen this when a father and son (with the same name) were applying for passports at the same time. Here's an excerpt from the "documentation requirements" list:

3. Present Proof of Identity

You may prove your identity with any one of these, if you are recognizable:

* Previous U.S. passport (mutilated, altered, or damaged passports are not acceptable as proof of identity.)
* Naturalization Certificate
* Current, valid
o Driver's license
o Government ID: city, state or federal
o Military ID: military and dependents

NOTE: Your Social Security Card does NOT prove your identity.

You may want to propose something like the statutes for CA or FL which really defines what is acceptable for ID for notary purposes. Refer to Florida Statutes §117.05(5) for a complete description.

Steven's Point? Thats where 'the House on the Rock' is....man, I love that place!!!
I remember walking into the room of the world's biggest carousel and all those musicals thru out the path! The doll house room...So many fascinating things in that place. The history indicates that he was an architect that went crazy building a house in the rock for his wife.

Close charm!

The House on the Rock is near Spring Green. Stevens Point is closer to the Dells. And yes the House on the Rock is fantastic. The Architect Frank Lloyd Wright's place (and school) is near by but he had nothing to do with the House on the Rock. I am sure his home did influence it though. It was created by a bored rich retired guy with a wife. It is full of giant music boxes, carosels, also one of the worlds largest organs. The gardens are fantastic! It just keeps getting bigger and Bigger every year!

I am very reluctant to continue a signing if they do not have at least one current picture id. If the primary is expired I go with a secondary with a picture. Otherwise I stop. Ultimately we are notarizing. I feel the lender needs to keep it clear with the borrowers in regards to the fact that with the passing of the Patriot Act a primary picture ID is required and it is to be current with no exceptions. There is no reason why the borrower could not have gotten a WI Picture ID for identification purposes. I have been asked by many companies to overlook and have them sign. I refuse. I ask them if they will cover my butt if this borrower turns out to be fraudulent? Well we all know what that answer is. Most often docs are redrawn and the person goes to the local DMV and gets a WI Picture ID. in place of a current driver ID. I win some and I lose some, but my commission is my only source of income.

I set this standard and I stick to it as a self employed individual. I bend over backwards for companies but on this I do not waiver. When I call the borrowers I make sure they understand that they will have to have current id's no exception. If they say they don't I call the company back right away and tell them this is going to be a problem and most times people get the problem fixed.
