Question on doc origination
I had a signing last night and the docs were drawn in Mrs. Bo's maiden name. She claimed she had given her married name on all application paperwork, and she had previously changed her original DOT to reflect her married name. Needless to say, it was a no-sign.
A couple of questions. Why would this happen? And is there anything I should of done besides walk away? It was a GMAC HELOC. TIA.

Did you call your contact before walking away to see how they wanted it handled?

It was after hours (no emergency #). Instructions said "SIGN NAME AS PRINTED, NO EXEPTIONS".

Don't you just love it when they leave no contact #. I guess I would have done the same. I have had this happen where the LO instructed me to have the BO strike, initial and print the correct name and send a copy of marriage license with BO D/L. But it is not up to us to make that decision especially when the doc instructions say "No Exceptions". In my opinion, you did what you could.

If you cold not get ahold of anyone and name on docs was dif than on Id there wasn't much else you could do.

I agree with previous poster who stated:
"have the BO strike, initial and print the correct name and send a copy of marriage license with BO D/L" if the borrower's D/L had the married name on it. Then they would also sign the Signature Affidavit page, if there was one in the package, showing both the maiden name and married name as names that the BO goes by.
I do a lot of GMAC work and they are very "forgiving". I think they would have preferred that the loan closed and would have accepted the above scenario. And if they didn't, they'd pay you again to go out with the corrected paperwork.

Even if it said "No exceptions"? I have had some instructions that have indicated that if something is to be changed to go forth and correct and initial, but if I had one that said "No exceptions, I'm not so sure without an okay first.
I agree that the LO probably prefers that it closed, but then they shouldn't put that wording in the instructions. JMHO!

For any other lender maybe I'd agree with you. But I've done hundreds of GMAC loans and thought the suggestion was one that would work. Like I said, if they didn't agree they'd pay to send you out again, but at least they'd know you made every attempt to save the closing. They're great to work with.

There was a handwritten post-it that said "Please sign as signature line reads." One more thing, the confirmation had her married name so that was what I verified beforehand.

I was correct to walk, there was nothing I could do to "fix it". Docs will be redrawn in her married name. Thank's to everyone who responded.
