I have notary instructions for the non borrowing spouse to sign the 1003. They are not listed on it. I find this strange.

Missy if your instructions state to have the nob sign then have the nob print her (assuming it's a female) name below the line and have her sign. No it's not strange to follow instructions. Just do as you have been instructed unless what you have been instructed conflicts with notorial law.

Non Borrower should not be required to sign a 1003, thats why he/she is a non borrower.

I have had several reqests from some lenders for the non-borrowing spouse to sign the 1003 as well as many other documents in the package. I have not found it that unusual. Bottom line is if my instructions are to have the non borrowing spouse sign in purple at exactly 7 pm after the first full moon of the month (??) that is what will happen. It gets done as long as no laws are violated. If you do have a problem with the instructions after you get them, you still have the option of turning down the job. After all, you are in business for yourself.

Personally, I would never sign a 1003 as a NOBS. Additionally, I would instruct the NOBS to read the statement above their signature prior to signing it if there were instructions to have the NOBS sign it. Particularly:

(8) in the event that my payments on the Loan become delinquent, the Lender, its servicers, successors or assigns may, in addition to any other rights and remedies that it may have relating to such delinquency, report my name and account information to one or more consumer reporting agencies;

I've only had a couple of lender requests to have the nonbor sign. And one of those requests was met with a refusal by the nonbor spouse.
