Doc Signing....what would you do??
I did a closing last night but the borrowers did not sign because the deed was incorrect. Original deed read Mr. Borrower, a single man. The Borrower is now married and they wanted to revise the deed showing them as husband and wife so a new grant deed was drafted and e-mailed to me. The closing was rescheduled for this evening. I called to see if I was to use docs from yesterday or if new docs were being sent? The settlement agent said she would send me the docs in a couple of minutes. That was 3 hours ago. The title company is in PA and no body answers the phones. I have left messages, been on hold forever and sent e-mails. I am not sure if they want me to use the old docs or not, all they sent was a new grant deed. Would you go and have them sign the old docs with the new grant deed?? This is a country wide loan?? TIA for any responses!!

They are in TX and are closed as well. The borrower tried to contact them too.

Definately call them. I've always been able to get a hold of the Countrywide LO's I've done signings for. If you can't reach them call the ss (if hired by one). It's quite possible that all they needed to add was that GD. If unable to reach them go do the signing and have them sign the entire package including DOT and GD. Then call first thing in the morning. If for some bizare reason they had to redo the package (which I doubt, but I'm not an lo so that's not gospel) it would be better to have wasted the time signing than to not have signed at all. That's just what I would do.

The old deed has the borrower's both listed and single? Does the grant deed override that? Again....no body answers at countrywide and the title co. hired me and are all gone for the night.

JB they knew the issue and had a GD drawn up. As much as I like to know things for personal knowledge I am not a title expert. I leave it up to them to decide how they want to do it. If they send me something and it ends up being wrong then that is thier mistake. The only mistake I have had in the last year on a GD is they had the name completely wrong. A wise notary once said "ours is not to ask why, it's to get the ink dry".

Countrywide are usually not date sensitive.
NREIS faxes instructions regarding changes to docs and RTC--did you not receive it?

if all of the other documents are in order, right names, dates, etc... and you have your grant deed, you should be good to go. It the lo needs more after receiving the packet, charge them again.
