Identity Question in TX

Okay, first - I should have know better. I received a call at 12:30pm for a Spanish same day signing at 6:30pm in the Broker Office (in Dallas,TX).

I went along with my trainee SP notary to answer questions about how to fill out the docs.

I look at the husband's drivers license and his name (chgd) is listed as Juan Julio Valdez; and his Permanent Resident Card shows him as Juan Julio Fernando Valdez. The docs show him listed as Fernando Valdez.

I called the SS and they tell me to have them sign docs as they appeared on the DL and get a photocopy of the ID's during the signing. There was also an AKA page which showed all of the possible spellings of the borrowers' names.

The wife's drivers license is listed Marina Petrova Valdez and the docs show her as Marina Valdez.

The husband signed all documents as Juan Julio Fernando Valdez and he used all 4 initials on all docs where required.

The wife signed her name as Marina P. Valdez on all docs.

Will these docs record properly?

I you do a search, there was a thread on this subject sometimes last week. I had this same situation before where borrower's ID show Stephen Jone Smith and docs listed him as Steve Smith. Lender/TC said that's how he's vested on title so just sign as printed. Experience also tell me that 9/10 instructions say to have borrowers sign exactly as their name appear on docs.

I'd doubt if those docs would record and love to hear who gets the blame if they didn't.

I will take the blame. Though I should have known better, I called the SS and told them how I was having them sign the docs. Even though I was told I could do it, that was not good information.

I did do a search for using the word resident card and identity and pulled up something from Oct '05. The notary refused to sign the docs, as the names on them did not match what was on the Drivers license.

I should have stopped the signing right there and called the SS and had docs redrawn right then. Egg is clearly on my face...but I will learn from it.

Frankly, I think it will depend on what office is recording the docs. You will get a solid answer if you call the county clerk where it will be recorded.

I think I wouldn't have signed as well. But please keep us posted with the results. It's real tricky with names that are so different than the ID's, but as long as the names are in the ID's you are good to go. Since all names werenot in the DL, I think that maybe you sould have alerted the SS first and then had them correct the pages with the corrected name...if that would even be possible.
