Mortgage question
I Have a signing tomorrow and the name of the Mortgagor on the first page of the mortgage is John L. Smith. The signature page shows Louis Smith, as do all of the other documents. Should I have the borrower sign as typed on the signature line? This would be the way he is signing all the other docs. There is a name aff. showing the name variation of John L. Smith. Thanks for any help you can provide.

I'd have him sign as printed. Usually the way it works.

Thanks, Beth. When in question I alway have them sign as printed. Just hadn't come across this on a mortgage before.

I had one last night where most of the doc's were just her first and last name. But some were first, MI and last name and one was full first, full middle and full last. I had her sign as typed and covered them all on the signiture affidavit.

We've been here for 18 years and have loved it. It's grown a lot in those years though and is getting kind of crowded - Might have to move north (or way south) when the kids are gone!

I love it here. It's so far from everything. The only time it is crowded is in the winter when the snowmobiler's arrive. December 15th to March and sometimes April. Only 2 hours from the nearest Walmart and 3 hours from the nearest mall. And the SS's are shocked when I tell them how far some of these signings are from me. No highways up here...and the warning signs on the road about "Moose Crossing" is no joke. Those suckers are big and dumb and refuse to get out of the way...at least the deer try to move for you. But still, I love it here and it was a great place to raise my kids.

1) What if you can't ID him as Louis because his DL only has John L. Smith?
2) Will your county record a Mtg. signed with a name other than the name that title is vested in? (doubt it)
3) A signature name aff does NOT cover you as a Notary.
Call the Title Co. and ask them how they want you to handle this and don't rely on feedback you recieve on a message board.
Personally, I would call Title and ask them if they want me to have it signed both ways. Most recorders will not record a Mtg. if the name and signature line do not match the vesting on the Deed.
