Opinions please.

I just returned from an appointment that was a "do-over" for a previous SA. A particular SS that isn't one of my regulars called me last night to go out and redo some docs. Seems the previous SA didn't fill out acks correctly, placed his stamp over wording. Did both sections of the ack for the DOT (yep/lender section, too), and notarized the HUD. I was told that this guy speaks with a thick accent so I wonder if it was a language problem or a newbie problem. When I returned, I let the SS service know the signing had been completed and in speaking with the woman, I found they did not know they were supposed to hire only LTPs in Maryland. She didn't know if this guy was a LTP. I did a search and can't find his name listed. Here's my question, if you were me would you report the guy or would you just assume it was a language barrier issue or a newbie thing and move on?

Language barrier or not you should report him because he is not an LTP and report the SS as well so the state can send them the MD requirements. If you let them get away with it what incendive do they have to follow the law.

I'm not sure if the guy is an LTP or not. The name that I think is his doesn't show up.

I would not report the person. It does you or anyone else any good. It is up to the Signing companies to use properly licensed/certified notaries. Let it go would be my advice. Life is too short.

I've been kinda leaning in that direction. My first thought was to report the guy. I'm not so sure if he's a LTP or not. If he is then his "crime" would be lack of knowledge. Let's face it we could all be reported for that at some time or other. It's just been eating at me since I left the borrower's home.

I take it Beth that you at least have the notaries name. Call him if possible and explain the statutes to him. I would at the least report the SS to insure that they do not use anyone else that does not have a TPL.

If it was just inexperience then I would say call him and let him know about the error. If he is not a LTP then he should be reported as he knows what he is doing is illegal and the SS should also be reported cause they definately know and choose to break the law so they can hire the lowest bidder.

Yes, the more I think about it, the more I feel it has to be inexperience. I can't contact the notary because I am not sure I have the correct name. I did inform the SS the contracted me of our laws concerning TIP. I definitely don't want some idiot with no clue and no license driving business down to the point I can't earn a living.
