Really confused

Ok Here's the situation. I signed a loan package, sent it back to the company(very respectable).fedex loses the package(tracked to Memphis but then gone) and then they ask me to do a" recreation of the package." They mean to date everything the same as it was but this takes place a week later. It is illeagal to backdate so it gets signed again as of that date. Now I get a call saying it was to be "recreated" as of the previous date.No can do-right!Is there a difference in the two?

Back dating is back dating. Post dating is Post dating!

Sometimes, when you have built good relationships with your clients and the signing is to take place say the next day, I have known notaries to go ahead, since the client was already before them and signed their book, say the day before.

Best word of advise. Don't ever do it and make sure you let your customers know, this is your Profession and you can not chance losing it, because the lender made a mistake.

Best of Luck to you!

Back Dating is Backdating.... forward dating is backdating... its all bad.

Golden rule....The day you sign, is the day thats on the papers

A notary friend had one where they got the docs back but when they sent in the mortgage to be recorded UPS lost the package. They had a copy but they asked to have an original resigned with the previous date. The title company sent a copy of the copy and everyone agreed to do that. The borrowers, the title company, the notary and the lender was even told of the situation so everyone was okay on the issue. No ones fault but UPS and they did indeed sign on that date previously.
