advice please
I signed for a great couple about a month ago at that time they signed a quit claim deed taking wife off of title, it made them a little nervous but did it anyway as the lo said she would be put right back on. I went back tonight to do the Grant deed putting her back on title.The instructions to wife were to fax the grant deed and the pcon back to escrow and thats it. Now I'm not asking for anyone to give any LEGAL advice , just the facts. Doesn't the original have to be recorded? According to borrowers something happened and the lo and his company had to pay out of their pockets because of a mistake he made ( really don't want to know ) but they asked me to help make sure this happened the correct way,any thoughts would be helpful. Thank You

I agree that the original should be recorded as long as the other deed you had signed was recorded as well. Here in Ohio, most recorders' offices have a website that you can search the recorded documents. If you have that capability in CA, maybe you can see if the other deed was ever recorded.

clarise I don't think we can do that here in ca. someone please correct me if I'm wrong the loan did fund so it did go that far, does it have to be recorded in the same place the other one was recorded in or can I do it here in my county if it comes to that?

Of course the original has to be recorded. There's no way somebody is going to get legal title to a property just based on a fax. Whoever told them to do this is either a complete idiot, or an unethical scumbag who has no intention of getting the wife back on the title. I'd wager on the first one.

I can take it to the recorders office where I live ( and the borrower ) to have it recorded? The escrow company is in Glendale,ca and we are in n. ca. This is a good learning experience for me.

Go online into public records....
for the county where it should have been recorded. I don't know if this is a county to county thing or a state thing but I can go into my county's public records and see if a deed has been recorded.
