when filling out an ACK

on a grant deed or for any other reason don't you have to put notary public after your name for it to record or be considered "legal. The reason I ask is becasue I had a signing last night where the borrower had another notary do the grant deed and the notary did not put Notary Public after her name?

It has been bugging me just wanted to know for sure. TIA for any answers.

Yes as of Jan 01,2006 You have to:

John Signer, Notary Public. At least in CA

Usually a notary would. However, not only notaries can take acknowledgments. Other officers of the state and courts can too.

I'm also assuming you mean on the signature line or where the notary's name is printed beneath their signature. Of course, with the new mandated CA acknowledgment, the certificate itself must state "before me <notary's name>, Notary Public". You will need to check on the exact wording required for the new certificates in CA.

The ack where it says before me jande doe she did not put notary public after her name. Does that make sense?

My understanding is that the new 2006 CA acknowledgment is fixed in the wording, requiring it to be EXACTLY as stated. That is, the words "Notary Public" must appear after the notary's name. No ifs ands or buts about it.

That doesn't make the document 'illegal' or non-binding, just that the notary certificate may be challenged as it does not conform to CA statute.

I have always included ,notary public, in my ack's. It was the way I was taught years ago. I have also received emails from companies I sign for along with instructions as to this new law with recent loan packages. I think that any notary that takes their commission seriously keeps up with the laws. The one's that don't, really should rethink their profession.

I always write Notary Public aftert my name. When I saw the ack on the Grant Deed that another Notary had done i was worried that it would be kicked back. I am signing the rest of the loan package and would not want this guys loan to be held up due to another notaries mistake. I was just curious and like I said it was bothering me.

It very well may be rejected by the County Recorder. You might want to attach a note for - or call - the escrow officer. BTW, the answer you're looking for is found on the SOS website. I recommend all CA notaries bookmark that site for easy access. Here's the link:
