Today, I received paymant from the company in question. In this case, which is the case most of the time, they choose to pay instead of go to small claims court. I have taken 3 similar cases to court where the company refused to pay when the BO ixercised the RTC and those three times the judge also awarded to me collection costs including the commute to court , interest and the late fees that I asked for. You just need to have your ducks in a row.

For the newbies out there that haven't had the pleasure of not getting paid, that means that once you get past the friendly reminder stage, you mail it registered with a return receipt requested. Faxes and emails won't hold up they can always say they did not get them even though you have proof on your side that you sent them. . You'll want to do that even if you plan on turning it over to collection later on. You need the paper trail. If the company does not pay, you will need to go back to court and get a collection order. It probably varies from state to state, but basically on the one company that did not pay, I took the collection order to their bank and after filling out some paperwork for the bank, the money was taken out of their account.

The court process does take time and I know most of you will not have the time I do to do it yourself, so that is where the collection agency comes in. It does not really matter what process you use as long as you do something. The companies that do not pay in a timely manner or at all are banking on you just writing it off and not going after them because of the time factor. Don't let them get away with it.

Oh Glenn! I think it's nice not naming names, but after all the trouble they put you through, I think it's only fair if you help put their name in our blacklist. But if you prefer not to, that's very much understandable Smile

Mike, I have done a lot of business with this company without an issue. They have never been mentioned in a negative manner on this board. Of course, they won't hire me again after this, but I am hopiing it was one idiot in one office that was the issue and not a new practice of the company. However, If I do see their name mentioned from someone else about any kind of late payment or payment problems, I will link my problem with it. That would show a pattern.

Excellent advice, Glenn

It has come to my attention that certain companies will only take us seriously
when we take our business serously.
This means payment for services rendered.
Professionals in other industries demand payment, why shouldn't we?
IMO there are too many in this industry that throw up their hands and wail, but
don't follow through when payment is delinquent.
