I've made a big mistake

I am new in this business.This was mine second loan signing through SS. I got a call at noon for a 8 pm signing. The e-docs didn't come until 10 pm. So I had no chance to look at them. When I went to borrowers home I realized there were 2 set of docs and it was 11 pm. The problem was The name on her Driver licence was Jane Smith but docs were Jane V Smith. She said the V was her ex husbund's name from long time ago. She didn't have another ID with the V. I know the rule but I couldn't think at that time. I was so nervous. A day ago I went to another signing where I made another mistake. I went to title comp. to fix my mistakes. She told me borrower had to sign excactly as the name on the docs. That is why I let her sign as Jane V Smith. I left house at 1 am. In the morning I understood I had made a big mistake. I could cross out V.

If I were you...I would do another notary or loan signing. I'm new very new but from the sound of your question and concern you are setting your setup the wrong way. The very thing you are asking about is the very first thing in the Handbook.

The other thing is you going by the loan signing question that signing should had never took place without the wife. Before leaving for the signing you should had communicated with the br to make sure all the players are there.

If they sent you the docs 2 hrs after the promised time which made you 2+ hrs late I would had viewed the instructions and asked him if his wife will be able to sign at that appointment you could had save yourself time and energy.

after reading these threads and my son experiences communication is key locate the players without them there could be no appointment. If all the signers are there the first thing I want to see is theri ID's

Did you take a Loan Signing class if you did all your questions would had been answered and you wouldn't made those basic mistake.

I took my Loan Signing class last night passed because I read everything more than once. I'm not going to jail for nobody nor risk my commission or pay fines!!

If you are a notary your class should had given you a handbook. When my son told me about this business that was the first thing he emailed me with the CA handbook my instructor gave us a handbook, notary traning manual and a DVD of the notary class

Please take a moment and review all the state requirements. If you don't have your E&O I would get it asap.

The original poster did not say anything about the wife not being there. If I understood it correctly, the poster stated that the name on the the loan docs had a middle initial of V and borrower stated the V was her ex husbund's name from long time ago. Am I reading that incorrectly?

Anyway, to the original poster, you should really, really study your handbook for CA as all states have different requirements. When in doubt, you can always contact your SOS directly.

E&O does not cover signing agent mistakes.

E&O covers only notary mistakes. It would be up to a court or the secretary of your state to determine if was a signing agent or notary mistake.

You probably wouldn't go to jail since there was no intent to fraud. You may lose your commission. Again, it's up to your SOS.

You do not have to contact the SOS. As far as the signing goes, it appears that the signing company is happy with the documents. They have no reason to report you. The borrower has no reason to report you. All you can do is pray that everything is OK and it won't come back to harm you sometime in the future - consider it to be a difficult lesson that you have learned from.

Now take the advice of all the good people on this forum and hold off on more signings until you know EXACTLY what you must do on a signing. Take a course. Study your state's notary handbook. Read the forum messages from the beginning to the end. Practice with sample documents. Don't get yourself into a jam again.
