Please help I'm new

John Smith is POA for his wife. He will be signing his name for both borrowers. Is it ok? Can he take an oath for his wife? And what I have to check? Please some advice... I have a signing in hours.

Hattie,
It would be in your best interest to become more knowledge about utilizing an POA. You are still required to ID the signor (wife). Obtain specific signing instructions from the SS or TC that hired you. You are also required to correct the verbiage within any Ack as needed.

Only the person signing the docs needs identifying.
If the husband is signing as POA for his wife, then you only need to ID the husband. You are only notarizing the husband's signature.

Sylvia, what would you recommed

In the event that a jurat is enclosed for the absent signer-attatching a loose ack for the absent signer? And having the present signer only sign the jurat and crossing out the name of the absent signer?
Or only having the present signer sign the jurat and leave the absent signer blank with no ack?
I'm curious as to your experiences with TC's adn how you handle that situation-they
always try to get me to have POA signer sign the jurat, but I don't- it's not valid.

Florida only provides an acknowledgment for a POA signer.
If the signer is signing for themselves and for the absent signer and it is a jurat, I will only do the jurat for the signer in front of me and attach a POA acknowledgment certificate for the absent signer. (If you need a POA acknowledgment certificate e-mail me and I will send you one)

Thanks Sylvia, that is what I do and use in place of POA jurat already, for the absent signer.
I just re-read my query and I'm surprised it made sense to you, LOL

You i.d. the husband, not the wife. Also...

what you do have to find out, Hattie, is the verbiage they want when husband signs for wife. There are a few variations, such as Sally Smith, by John Smith, attorney in fact (initials would be SS by JS, aif). If it doesn't show on the signature line, you need to call and get it clarified.
