Quit Claom Deed Question
I had a question placed to me and I am not sure the answer so I thought I would throw it out there. I am in the state of Pennsylvania.
I have a minister that is refiancing his home, but wants to turn his house over to the church. My first thought was a quit claim deed but he is refinacing and I am not sure if that would work. Does anyone know the answer?

Robin, you are a notary public. You do not ever attempt to help people decide what to do. They figure out what they want in life and if the paperwork must have a notary seal you put it on period. You will be before your county's bar association and the AG quicker than you will know what happened if you are suggesting to people how to vest property. This guy has a lender to aide him in the refinancing and if he has questions he should pay a lawyer. I saw on PAN you asked about filling the QC Deed out. Even if this is what the guy wants, you shouldn't touch that deed. I know we are allowed 'clerical functions' in PA but filling out a deed form is too close to the line. The only ones in PA permitted to prepare deeds are attorneys, title insurance companies if they are issuing insurance on the property and in certain circumstances realtors - NEVER a notary. Vesting of real estate has SIGNIFICANT ramifications.

There are title ramifications about the choice of deed type
That you DO NOT want to be responsible for.
I know the answer - but won't say so. If I did, I'd be quilty of UPL, and so would you if you advised.
Please tell your minister to consult a real estate attorney in his area. If he wants to make sure the title to the Church is bona fide, the time with the attorney is worth it.
