Compliance Agreement?
Did a signing last week that was e-docs. This morning the lender is contacting me saying I failed to notarize the Compliance Agreement and sent me a .pdf of the document. When I evaluated and printed out the document, it has no place for a notarization, no notarial wording, and does not have the State/County typed on the top. Nothing is cut off on the bottom. At the very bottom it says the name of the form and page 1 of 1 so I know nothing is missing.
Should I have notarized this? There was nothing on this doc that indicated to me I should.

It is up to the originator of the document to provide notarial language in ack or jurat format if they wish it notarized. The notary cannot add notarial language to a document on his/her own - it's called UPL! You were correct in not notarizing the doc.

Some packages I've done have the place for notarial wording on the Compliance Agreement so then I notarize it. Other packages don't have the wording so then I don't notarize. I just figure each lender is different in their requirements. We aren't mind readers though, so they need to indicate a notary block if something is to be notarized. You did nothing wrong in my opinion.

Thank you both. I received an e-mail a moment ago from the lender saying after reading my e-mail and looking again at the doc they realized no notarization was needed.
