Dates on Docs
I have just printed docs for a closing on Thursday and all the dates have been filled in for June 12, 2006 (closing will take place 06/15/06). I know I HAVE to change the date and initial corrections in my acknowledgements.
My question is, do the borrowers change the dates next to their signatures and initial, and do I change dates at the top of all other documents or just leave those alone? TIA for your input.

What did the hiring party advise you to do? Of course you must notarize the correct date....

Do not change the date of the documents, as the Correction Agreement will cover the correction, and the title co. will make the necessary changes.
The borrower would change the date and initial when the date appears by their name and you would change and initial the date in the notary section.

CK, I agree completely with Misty...do not assume you're doing the correct thing when it comes to dates OTHER than being absolutely sure your certificate is correct. ASK THIS QUESTION TO THE HIRING PARTY.

When the date is pre-printed next to the borrower's signature line, they have to correct it to reflect the date that they signed the documents. The hiring party cannot direct that a borrower sign using the wrong date.

well Lynn, the reason for my comment is this...
I have received 2 packages in the past 6 months with incorrect dates, called Title to "inquire" about the problem and guess what? They hadn't caught it, thanked me for the call and sent new docs! The smart thing to do is NEVER TO ASSUME, it'll bite ya every time.

Clarification: I agree with you Sue
I have had a couple of times where the wrong docs were sent, dated earlier. The paperwork had been modified but they had mistakenly sent the earlier un-modified paperwork by mistake. I don't agree that brw's/lenders can't decide to sign with a different date, but I won't notarize for a different date.

I don't agree. Borrowers can put any date they want to in the package. I have done many late night signings where the docs had to be signed on a particular date. I have arrived at 11:30 PM, and after ID'ing the brws, we completed all the docs requiring notarial certs to be done by midnight. After midnight and still signing, the brws signed the same date of the notarizations on the non-notarial docs at the request of the lender, by their own free will. Only the date of the notarial docs are my responsibility.
