Opinions Please
I had a signing tonight and Mr. Borrower quitclaimed and only Mrs. Borrower signed, now they want me to go back and notarize a Grant Deed to put the Mr. back on title, I know as a notary I am to be impartial and its really none of my business why they are deeding in and out right? I'm just a little uncomfortable about it, any opinions will be greatly appreciated!

It happens. Usually one borrowers credit is better than the other borrower. I wouldn't worry about it. I doubt it's anything nefarious (sp?).

Thank you christisocal thats what I thought and I just finished reading the thread #123781 which also reiterates that, but I was a little uncomfortable. I feel better about it now

that happened to me once with one borrower. I had to go back sign another deed and another NKA because the guy now goes with the same name with one letter different in his name. I got paid as a full signing for that.

Yes, you are supposed to be impartial, but it's good to recognize and want to understand. I liked your post because I learned something from it myself in the responses.

The problem with this is that most mortgages contain acceleration clauses. If the mortgage was taken in the name of one party, and that party conveys an interest to someone else it may constitute a sale or change in the relationship of the mortgagor to the title. As such it may invoke the acceleration clause which would require the mortgagor to pay the entire amount of the note on demand. Before the mortgagor conveys any interest in title to the property the mortgagor should obtain the written consent of the lender.
