Permission from another notary?

Question about an acknowledgment made by another notary with the County not filled in. Recently I accepted a job to deliver deeds and other documents to be recorded to the Clerk's office on a daily basis. While performing this task today I noticed one of the deeds was notarized but the County was blank. The signing service called the notary and she called me (small town) and gave me "authorization" to complete the County on the Deed. Can I do that? Just wondering how some of you would handle it.

Thanks.

Legally, I'd guess that you're not allowed to do it. But in reality, I'd do it. It's not like you're forging her signature or altering the date or anything.

I would without hesitation. If you two are in the same small town, maybe someday she'll be carrying your document and can help you out.

Thank you

Thank you for your feedback. You both make good points. As it turned out I decided to ask one of the clerk's to hold onto the deed until the other notary came in to do her morning recordings (she works for a title company here in town). That way she can finish the notarization and I won't feel squishy amending her acknowledgment.

I appreciate your thoughts and like what was said about helping out another notary.

Re: Thank you

So you got 2 responses telling you to do it, but you still decided not to do it? What exactly was the point of asking in the first place then?

My question was

If I COULD do it. I was not sure if such an act was legal. I ran the deed down the recorder office before reading your responses also. I wanted a couple of opinions and I got them and again, thank you.

Re: My question was - Kathryn

In actual terms of "legality", it would not be appropriate to fill in someone else's certificate. In the strictest sense, it is NOT legal. Cali stated that, so let's accept it as a fact.

The notary (who YOU called) asked you to fill it in for her, and gave you *permission*. It becomes a judgment call at that point. I'm not aware that there is a notary policeman at the county courthouse, but if you were worried about it, you could note it somewhere should there ever be a repercussion about you're doing her a favor by saving her hinny and not having her document rejected. That is bad for ANY notary, and most of us, as notaries, appreciate any help from the "inside". Unfortunately, I have to do it alot because of my position, and poor work by notary signing agents.

It has little or nothing to do with the fact you were being *nice* unless being nice is something you're comfortable with, and want reciprocated. If you're not - and you are this hesitant about the issue, you already answered your own question by your own discomfort.

So, if the question is *could* in terms of legality, the answer is no. Yet, I would do it especially if I knew the notary or had permission. It's a question of judgment and no one else can do that for you.

hinny: a hybrid between a stallion and a female donkey -- compare MULE.

heinie: slang: buttocks

So, is this signing agent into large animal rescue, TG, or did you just fail to use your spellchecker? Actually, I think I enjoy the image of her leading a long-eared equine out of the courthouse even more than the more munane pictue of her doing a sloppy notary public a favor.

Me too (well except for the donkey analogy. I prefer the Elephant myself). A$$ Saving is a full time job, alas. But Someone does have to do it. At least that is what I tell myself while driving off to work. It's just a tough job to save the world. Where's Superman when you need him? Dammit, I'm tired.

Re: Munane...Now thats funny....

An English lesson, as well as an admonishment for failure of employing a spell-checker...then
the use of "munane". Hmmmm... OK I'll take my best guess;

MU - 12th letter of the Greek alphabet

NANE - Scot. ...None

Mixed people and times...so...Oh I Got it!

You are drawing reference to the 12 Scandinavian demigods...and dismissing them outright
( 'None 12') in favor of LOKI ( the 13th demigod ) who brings great misfortune upon humans.

Yes ? Did I get it ? Do I win ?

or did you mean mundane....

"telling my age"

LOL.... Are you refering to the Elvis Presley Genre?
The Johnny Mathis Genre ?
or .. The origin of the phrase ? ( mid 1500's..along with 'Blue Moon')

in any case, I don't see Hugh professing his love to some Nth degree to anyone....not even his new complimentary dance partner.

When I was an employee of the Register of Deeds office......

........we supplied bottle of white out to the people that came to the window for use to review and record their docs. If we rejected a doc because of a venue issue, the title company employee would just fill it in and put it through.

Seems to me from reading the boards since 2000, that CA treats the ack/jurat as some type of notary holy grail.

Think this is state specific. No person is in a Michigan State prision for touching the "sacred notary block."
