Sounds like the title company (closing agent) may be liable for a big chunk of the misappropriated funds. This, of course, does not absolve the broker/loan officer of any wrong doing. I wonder why the closing agent would write two checks. I'm sure there is more mystery and intrigue in this scam.

Glad that I am honest. I have been with borrowers, who .....

if believe would sign a doc giving me
their first born as a slave if
I put it in front of them and told them that it was
a closing affidavit.
They were fully competent, just in a hurry to get back to
watching American Idol.
