Signatures Plus
Help, Help - I preformed two closings for Signatures Plus. One in January 06, the other February 06. Total amount for 2 invoices 115.00. Finally received payment May 12, 06. However, both payments have been return NSF. Anyone out there have any suggestions on how to collect? Note: To all Notaries - Do not work for this company. They are bad news.

I got paid from SP after nearly a year by contacting the title company and the lender on the transaction.
If a company you have never heard of calls for a signing, use the search button and see what other notaries have said about a company. Signatures Plus has been having problems for quite some time. The other policy I follow personally is to only do one or two for a new company until I see how they pay unless I find glowing reports about them on the boards.

To bad we have to resort to contacting the lenders and Title Co's to get paid. But it is the only way to force the non payers into accountability to their clients.
Years ago tp-ing a house was a big no no. In the little town I raised my kids, it got to be a badge of honor...it meant you were popular. Then came the community service requirement for graduation. Homeowners flocked in to the school with requests for tp cleanup. After a day or 2 in the elements its a hard thing to clean up.We all know that messes are harder to clean up than to make.
Non paying Services have to realize that. How much time are they spending explaining themselves to us and to their clients. It has to cut into their profit margin through lost clients, lost notaries and loss of respectability. How much of that lost profit are they trying to make up by trying to cut the fees of the notaries? Improving their accounting systems and relationships with clients and notaries would improve their efficiency...thus their "expenses".
Sometimes I think this is a hole in RESPA...the use of the middle man to contact a signing service.

With all due respect, what the heck has RESPA got to do with it? Please, let's not get the government involved with our contracting abilities. RESPA should be setting the rules. How those rules are implemented should be left to the businesses. Just like the Patriots Act. It is the compliance and compliance enforcement that the rule making authorities need to do. The methodology of how to accomplish a task is not part of that, any more than allowing a title company or signing service to tell us how to do our jobs.

You are right..as usual. I am thinking in terms of payouts on the HUD which says all affiliates are being paid..which often includes the SS but not listing the actual notary performing the service. Is the SS a sub contracter or not? If the SS does not pay their notary they are in breach of contract to their client the Title co.
Sheesh...here is where I say i am not a lawyer.

I would contact the secretary of state and report the NSF to them and ask them how to file a formal complaint against them with the State. Might help. Just a suggestion.

Bouncing checks is an illegal activity and falls under judicial purview, not administration. Therefore, the State's Attorney and/or Attorney General's office is responsible for the investigation and prosecution of NSF offenders.
Under Florida law, any check returned from a bank stamped "NSF" (Non-Sufficient Funds), "Account Not Found," or "NSF Unless Otherwise Indicated" is a worthless check that may be subject to prosecution as passing worthless bank check under Florida's criminal statutes.
