They won't pay, what would you do?

Took a closing from Notary Pro, which I don't usually do because of their very low fees. But I did this one time because it was in the same area I was going to be and I had enough time before my next appointment. Well the single loan turn out to be double and the borrowers were trying to sign docs, while keeping 4 toddlers content at the dinner table. So the 30 minute closing turned into 90 mins. After the signing, I called NPro and told them it was a double loan and I need my fee adjusted. He said the max they can pay is $75 for 2 loans!!! And he won't budge. He apologized that the signing turned out to be double (not that they didn't know, the scheduler did not read the assignment). I know that it wasn't intentional but I feel that I've been had. I certainly would not have accepted the closing for $75 under any circumstances. so I tried to get out of the fax back since I'm not getting paid my fee...he said if I didn't fax the required docs back, they will dock my fee!! Obviously, they were not willing to give up any portion of their kickback for their mistake. Never again Notary Pro!!! And mind you, for that one job, they used many of cell phone minutes for babysiting me throughout the whole assignment!!!

done a lot. Thanks for the warning. I do appreciate knowing this about them. They seldom call me . . . I have never done one for them but that's very underhanded.

In the real world, you'd hold the documents hostage until you got the right fee, but in our world where we appreciate the borrower and honor our commitments to what is right, we cannot do that.

Send me an email if you don't mind. This interests me...maybe I can publish it and see if they want to do a response.

Great minds work alike. I was just thinking the same thing Brenda.

Well...I try to come up with stuff to read that's worthwhile.

I think it would be worthwhile to get the notary's point and ask for a counter-point from NotaryPro.

I swear, if I get another news bulletin from SSs on how to properly fill in loan document blanks I'll scream.

The only way to provide interesting information is to play part-time news reporter. I have never done that but hopefully will get a part for it on tv some day. Smile

Maybe I can get the part of "deep throat" (shut up Doc) on the next Nixon movie.

I just got an email from someone in Texas asking me "where are you going to publish this incident?" Now...if that person would just tell me "who is asking" I might answer.

Agree with Brenda and Lawrence. Speaking personally I just don't work for them. They won't meet my fees and I think they put you through a way to many "hoops."

Brenda has a very good idea.

Well, I guess it's better than a poke in the eye with a sharp stick! But still pretty cheap!

Only suggestion I can make is that if you ever run into this again with someone else (and you undoubtedly will, if you keep doing signings), make sure to re-negotiate the adjusted fee *before* you complete the assignment. Even if that means stepping outside the borrower's home to make the call, if you don't find out until you get there. The only exceptions to this for me would be with companies where I've consistently and successfully had them adjust fees before, as appropriate. Once the docs are signed, you have no leverage. Before they're signed, they will be worried about having to find another notary.

What are other people's takes on ...

... renegotiating before the signing, even if it means that you find out at the signing table? (That is, docs went to the borrowers, you were told it was a simple refi, you find out at the table that it is a first and second.) If you did attempt to renegotiate, how could you trust / would you trust that the company would actually email you a new confirmation with an increased fee?

I'm asking about the morality, as well as the logistics, folks!

Re: What are other people's takes on ...

FWIW, it's been my experience that most of the time the signing service doesn't even know there is a second in the package. They will be charging their client more as a result, too, and will be glad to know that. I've never had a problem with it. If it's a title co., they should know better.

As for the trust issue, others may disagree with me, but sometimes you just have to go with it. The repercussions of not following through on an assignment I committed to do (my reputation, the borrowers' loss and inconvenience, etc.) are to me much greater than the potential loss of some one-time income. And if you're careful of who you work for and do a good job for them, you are unlikely to have a problem.

Looking back at an app., I see that their stated fee is "E-mailed Combo....$100.00". Their "Standard Combo....$75.00". Notary Pro, don't call me I'll call you.

Here's what I would have done...

When I realized that it was a double loan (you did print the docs, right?) and BEFORE printing anything, I'd have called Notary Pro back and asked for an adjusted fee. No adjusted fee, no print, no signing done by me. That would have eliminated the fax-back and threats that they will dock your fees.

Hopefully, you've learned a valuable lesson about this company and can find a way to laugh about this later. Smile Good luck!

Re: Here's what I would have done...

MelissaM FL You are 100% correct. As I stated in an earlier post I don't even work for them. They will not meet your fees and have expect you to jump throught all the hoops.

Tough lesson to learn I'll agree with that one.
