"Formerly known as" question....

I have a loan where the wife is on the Deed Jane L Doe formerly known as Jane L Jones. I'm noe confused about that but the rest of the docs just have her as Jane L Jones (current Married name). I thought that borrowers had to sign their name consistantly on all docs (so whatever is on the deed should be what is signed on the note. TIL etc.) The closing is tonight and I can't get ahold of anyone at the title co. Should I just have her sign Jane L Doe formerly known as Jane L. Jones on all docs regardless?

The Deed (of Trust, I assume) is the document being recorded. Therefore, sometimes the lenders/title do this to reflect that the borrower changed her name during the course of her owning the property. This way it will show in the chain of title. Technically a QCD should be executed, but I'm not going there...............

As Lee said, just sign the rest as printed. The rest of the closing documents ARE being issued under her current name.

That's a tough one since you aren't supposed to change anything without consent. When I call to confirm aptmt with borrower you should confirm time, address, name including correct spelling. Have you talked to borrower about this? Is it for sure that she is nka Jane L Jones?
Seems like kind of a da**ed if you do and da**ed if you don't. I would say you can't make that judgment call or it's UPL. Do they have any contact info for someone after hours? Thing is it is usually said that only the title company can give the ok to change so I'm not sure if the loan officer could help but it's worth a try if they can get ahold of the lo (to see what the lo thinks).

She is now Jane L. Jones. All docs have Jane L. Jones, except DOT (assuming you meant DOT).
Sounds to me like they erred on the DOT, either flipped the names, meant to say "Jane L. JONES, f/k/a Jane L. DOE", or alternatively meant to say Doe, NOW known as Jones.

What I'm wondering is how you'd identify her as Jane Doe, (to notarize her as such, on DOT)knowing she's NOT Jane Doe, she's Jane Jones, but I know zip about your state. Anyway, I'd have had her initial page one of DOT next to vesting, allowing title to correct if necessary, and I'd have had her sign her current & correct name on signature line, and then would have had that same correct name on my ack. The rest of the pkg is correct, and if it ain't broke ...

If it's all exactly and precisely as you say, then the error seems obvious to me, and that's just what I would've personally done. You would certainly not be wrong to leave it as is, have it signed as is (assuming you could ID her as Jane Doe), and let those chips fall as they may.

Thanks all. I have her sign the DOT Jane Doe formerly known as Jane Jones and the rest of the docs Jane Jones (as preprinted). To answer Renee;s question. I took a copy of her driver's license with Jane Jones (married name) and she happened to have abour five copis of her certified marriage cert with her maiden name so she gave me one of those to send back
