acknowledgement needed?

I am pretty sure I need to add an aknowledgement to this, but I just want some reassuring. I have survey affidavit and owners affidavit that say the following in the area to be notarized:

SWORN AND SUBSCRIBED before me, a Notary Public, the day and year aforesaid.

Why would you attach an acknowledgment?

Because there is no date anywhere on the document.

But why add an acknowledgment. You already have a jurat. You cannot add another type of notary certificate without approval from someone or it's UPL.

If the jurat that is on the document does not meet your state requirements then IMO you would add a loose jurat.

So there is no date, did the borrower sign and was there a spot for them to date? Whether their was or not IMO is irrelevant. If the jurat certificate does not meet your state requirements attach one that does with the date. Hope this helped.

Ok. I would think somewhere in your jurat you should have the date though. What state are you in?

>>>I am in Florida, but no there is no date anywhere.<<<

Then do what's necessary so that there a date.

That's why I am asking if I should attach an acknowledgement, because I have never come across this before.

It says: the day and year aforesaid. I am assuming that there should have been a date at the top of this doc where the State & County info is and it was left out?? I don't know!

PAW can you lend a hand here?

Anon. You keep referring to adding an acknowledgment. It would seem clear that it has a jurat already. If there is no date or spot to have inserted a date anywhere on the document itself then IMO, I would be certain to add a certificate that reflected the date of notarization.

Look at your state SOS for minimum requirements of a jurat. If the one that is there does not comply then add one. You should be able to find one on your SOS site.

PAW could or would you consider lending a hand here?

Anon needs more than a helping hand, he needs a clue

Anyone who can't figure out on their own how to properly attach a jurat that conforms to their state requirements should not be within 10 miles of loan documents.

And any notary that keeps calling a jurat an acknowledgement deserves to have their notary stamp taken away and smashed into teensy little bits.

These are the exact types of posters nobody should be helping on this board, they're the ones that have turned this industry into a joke. Big shock that Missy Agenda would put so much effort into helping, I'm just surprised there was no invitation to email her to avoid the meanies like me.

Add the venue above Sworn and subscribed - unless it is at the top of the document.
Add the date after aforesaid (or you can line through and initial the day and year aforesaid and then add the date.
Then you need to add "by - name of signer/s" and indicate what you received as identification.

Sign it, print your name under your signature and put your seal on it.

(The certificate must always contain all 9 elements according to Fl notary laws, if they don't you add them)

State of Florida
County of -----whatever
SWORN AND SUBSCRIBED before me, a Notary Public, the day and year aforesaid, June 16th 2006 by John and Jane Doe who presented drivers license as identification.
