In cases where you are owed money and do not have records of the lender/loan officer's name and phone number, and you wish to contact them as a part of the overall collection efforts, have you ever called the borrower back to advise them of the situation and ask for the information? Would that be considered out of line? Thanks.

I have always been against contacting the borrower. It seems less than professional to me. Having said that, I understand the need to collect on an unpaid account. Message 110293 seems to be helpful. I haven't used the letter yet, but love the way it's worded.

I think it's out of line...

These precautions should have been taken prior to the signing. If proper records are not kept, then there is no recourse on your end.

Look up the mortgage recording online and get the lender's name and address from there (1st page, upper left hand corner).

Then you can look up their phone number at one of the many yellow page sites.

I would suggest keeping this info on all signings you complete, in case of this situation.

To avoid this in the future I would suggest developing what I call an "Assignment Worksheet".

I complete this form for each and every signing. It details ALL information relating to the closing. Some examples: Date/time accepted, Signing agening/contact name and numbers, Type of closing (single/piggyback/edocs...), Lender name/contact/numbers/loan #...), Borrower name/address/contact numbers/time apt. confirmed, Mileage info, return shipping info (tracking#/address/when shipped).

I DO NOT record borrower personal info such as SSAN or DL#.

I can provide a link to a PDF version of this form if anyone is interested in it. Having such a form with this info can save you!

That's a good idea. I think PAW has one also. I think keeping a notebook of these is the way to go. I got lazy and started just keeping confirmations, but you are so correct.
