Bonds and Oaths

I received a call to subscribe the oath of office for a new notary. Anything in particular I should know other than the obvious, ie; identity. Couldn't find much in my SOS book. TIA for your advice.

Hi Cyndi, just an easy notarization, with preprinted jurat wording. Make sure the signer signs in your presence. There should be two originals to notarize.

I don't know what the rules are in California, but some states do not allow a notary to charge a fee for administering an oath of office. Perhaps you didn't plan to charge a fee anyway, but you were, you might want to check if you are allowed to.

Why answer if you're not from the same state?

The question was state-particular. Do you just answer to hear yourself talk? Cyndi, it's a simple notarization. Yes, you can charge a fee for travel and the signature.

Wrong!

You are not charging for an oath in California: You are charging for the notarized signature that requires an oath. Re-read your book Cyndi or call someone else from the SOS.

Sec 8211 b) For administering an oath or affirmation to one person and executing the jurat, including the seal, the sum of ten dollars ($10). I wasn't suggesting to charge only for the oath. And I read my book thank you very much.

Remember to give this oath, your principal place of business must be in the same county where the new notary is filing their oath and bond. And the paperwork for the new notary must be received by the County Clerk within 30 days of receiving the commission.

The California Jurat = Oath or Affirmation. When performing a Jurat notarization, the CA notary must give an oath or affirmation to each signer. Hense, it's all one "notary act" per signer performed.

Question: Okay, it's been four years but

I thought the oath was given to the notary at the County Clerk's office, then you hand over the bond (along with a recording fee) for it to be filed to same notary. At least that's how I've done it three times now.

What's changed? Why are ordinary notaries giving the oath to new notaries? I'll be doing this in about a week, so I'm really curious.

I understand a notary can take oaths...I just thought it was all done in one place. Never heard of going outside the County office to give the oath.

TX notaries give oaths of office. I went to a notary to take mine.

Other notaries in Texas. Get Legit! Check your commission papers with your edu materials and GO take your oath if you have not. Not supposed to notarize until you do.

Ok I would have to look this one up. My fuzzy memory says that we are going through the process of getting our commision we can have another notary give us the oath then they mail in paperwork. Now I know I have the details screwy. But I do remember that I didn't want my paperwork going through the mail. I chose to drive into San Berdo from Victorville to physically hand the paperwork to them and take my oath.

My commission is still in San Bernardino County, I swear that's how I did it...twice.

I just assumed all Clerks office had a notary on staff to save people the trouble of going out and giving the oath...

A new (or renewing) notary has the option to 'File in person' (County Clerk's Office) or 'File by Mail' (find a notary in the county where your oath will be filed). It's been like this for at least the past eight years. To file by mail takes a little longer but sometimes it's more convenient.

You can give your oath to another notary and then send it by certified mail to the county recorders office for filing. When I went in for my Oath, the clerk did it right there. Doubt if she was even a notary. I think this is a convience thing for these people. Appt is for Sat., so I imagine one or both work during the week.

History Lesson -

You used to have to find a notary BEFORE you got your commission.

You had to go swear you'd uphold your duties prior to your application being accepted.

Now, you apply, you get your commission and on the back is your oath of office.

Just for fun, go ahead and take it to a local notary to do it. Yell at them because they do not have you swear or affirm but will merely sign and stamp it. Start crying and tell them they ruined your notary life.

Refuse to sign their book. (They will not realize you do not have to do so in Tx any longer.)

Then, hand them a piece of paper with "Just kidding....I'll sign but you ARE supposed to have the notary raise their hand for an OATH.

Beware that the Notary Police are everywhere. If you don't believe it, check the internet. That "Bible Thumping Who__" named Brenda is one of them. "

Okay, that was a long way around getting to the Bible Thumping WHOR_ statement that was emailed to Korey.

However, I know that the person who hates me enough to write that about me is one of the few who would read this diatribe. To the person who wrote that...I think you probably know by now that I know 99% surely who you are. I had a couple of people look at your email over the weekend and you are a smug one who needs to realize that you, just like Scott Peterson, are not as smart as you think you are. Get a life "sweetie."
