DOT and Note Having Matching Dates

On 3/7/06 MaryP/PA had an interesting problem (Msg#102780) with how the borrowers held title on their home with initials previously and without initials on this new set of docs. Some notaries had suggested she get in touch with the SS and find out if she would have to go back and have them resign the DOT to match how they held title in the past. She should go back for a trip fee. Here's my problem with that, the signing was last night, so she'd be going back today and that would change the signing date on the DOT, it wouldn't match the date on the note or any other docs in the package. Maybe I worry too much about details, but seems like a big problem to me. I'm glad Mary didn't have to go back out there, but what if she had?

It is my understanding that it's the printed dates in the body of the docs that need to match not the signed dates. But it is my personal feeling that it's the one who draws up the docs responsibility to make sure that what is in the body of the docs is correct. They should do thier jobs and we should do ours. That is why they are lenders and we are signing agents each of us have our own area of expertise.

If the borrowers want to inquire as to why the vesting is different, that's their call. Not mine as a Notary Signing Agent. I wouldn't even discuss the issue with the borrowers, I'd refer them back to the Lender.

If it's wrong and has to be re-signed, then that's another fee. Not our place to read the docs and determine whether they were prepared correctly. Not my job/place as a Notary either. I'm not responsible for the contents of the document, unless I find out that information in the document is false, then I can't notarize the document.

Thank You Terri

Great response. It was what I was thinking. You just did a great job of putting it together.
