Doing my first signing tomarrow, I have one questions

I have not received the documents yet and I probably will not until I get to the mortgage company. I have been reviewing my loan signing book just to make sure I do everything correct. But I have not found out the answer to one of my questions. When I notorize the deed and if it does not state notary public under the line where my name goes or my signature, do I write it in after my signature or under my signature. For that matter even if it is under do I have Sign my signature, then write notary public.

Ex : (signature), Notary Public If Notary public appears below do I have to write Notary Public regardsles.

The deed will be recorded in California

I want to make sure I represent the profession positive also they offered me $65 at their location, I want to make sure I charge correctly to ensure the integrity of our profession.

On the line where is states:
Before me.............put John Q Notary, notary public

On the signature line at the bottom where you have to sign:
signature it: John Q Notary and you don't have to put "notary public" after your signature.

I hope this helps?

Take note that I am a Texas Notary and I am not tested on CA notary Law. However, I have seen this discussed enough here to kind of remember what was said. YOU need to figure it out by looking at what's in the CA notary handbook.

The resources you need are below. Your signing agent manual may not specifically cover notary LAW. Notary LAW is totally different than a signing agent manual. You laws may be included in your manual - I don't know. But if not, find the link below and refer to it.

I am only answering this in case you need it first thing in the morning. Please do not take my word as accurate because I am NOT a CA notary. First signings make you have problems thinking things through. You need your NOTARY handbook/NOTARY LAW for this answer.

California Business Portal - 2006 Notary Public Handbook http://www.ss.ca.gov/business/notary/notary_hdbk.htm

2006 Notary Public Handbook

The handbook contains California laws relating to notaries public and is designed to assist you in preparing for the notary public examination. Page 4 of the 2006 edition includes a summary of amended and new laws effective January 1, 2006.

If you notarize any acknowledgement, and it is preprinted up for you, and it says notary public, below, Then no you dont have to do that, but what I would suggest is that you go to ss.ca.gov, and look for the new acknowledgements, and print those up, and try and use those if at all possible. The state of California is cracking down on notarizations, so the best thing that I do is CYOB cover your own but, you dont want the wording in anyway to look different then the state acknowledgements, and you what it to be as clear and clean as possible. If you are doing a loan doc, take the doc back to your home, and take your time, you do not have to notarize directly in front of the borrower from what I understand. Last part of my advise is, take your timr, you are in no hurry what so ever, and do not disclose anything about the doc whether you agree with it or not!!! That is my bit of advise if you dont mind me saying. If you need any help you can contact me at [e-mail address], and my name is Mike. I can understand how nerve racking it can be when you just get started, and I would be more then glad to help you if you need anything answered.

Good Luck and Another good reason

why we recommend that starting out you only accept assignments from SS (signing services) overnight docs. That way you will get the docs at least several hours prior to the signing and will have ample time to go over them, flag them (if that will decrease your anxiety level), put them in the order you will feel most confident with. I always start out with the HUD (Settlement Statement), then depending on how I read my borrower whether I pull out the RTC (3 day right to cancel) or go directly to the note, then the RTC. Then the TIL (Truth in Lending) checking to see if the box for the prepayment penalty is checked. If it is checked, I then go and locate the paperwork for that. Then the Mortgage or DOT (Deed of Trust). After those most important (to the borrower) docs are completed the rest should just fly along. Also by using SS to start with, you will have built in mentors right there in their office. Now a word of caution, most of them (at least the principles) have done a car load of signings, but they may not be familiar with your state laws and requirements, i.e. If you're from a midwestern "dower" rights state don't necesarily expect them to know exactly which docs the non-borrowing spouse needs to sign(at the minimum, Mortgage, TIL and RTC as well as some of the title docs); on the other hand, don't expect a non-california SS to know exactly the correct wording on CA (or FL) acknowledgements or a CA specific jurat. They may or may not know this cold. I HATE fax backs, but they can be a godsend to a newbie because you can correct your mistakes while they are still correctable. This is a decision only you can make. Under no circumstances would I recommend a newbie accepting an assignment where the docs go directly to the borrower. My associate that I mentored accepted one of those for about his 2nd or 3rd signing. When he told me I said, "I'm coming with you". We passed it off as that neither of us had ever done one for this particular lender (which was the truth). I would have had no problem because I have done many, many loans, but to someone just starting out it can be very daunting to see the docs the first time in front of the borrowers. If I find myself in this type of situation, I usually smile and say, let's see what we have here, I haven't done one for this lender in a while. Even if it is a lender you're very familiar with it can be disconcerting to say the least. The same problem can occur if you are working as a contract closer in the title company's office.

Hand-On Assistance Available Right Now For Any CA notary Pub

Go to www.NotaryClassses.com -- look down toward the bottom and you will see a way to actually go thru the process of completing a California Acknowledgement, a CA Jurat and how to atch a loose certificate. I think you'll need Flash (?) but it's free to download if your computer doesn't have it.

Once you start the lesson, you'll actually HEAR Dan's voice while you watch his cursor direct you, filling out the forms as he goes along- pretty cool stuff. It's like having someone right next to you showing you exactly how to properly complete your certificates.

Hope this helps! kelly

What? Where's the advertising? I just answering the question.

Look up at the Notary 101 tab. It's clear that Dan and Harry work together and are business affiliates.

Kelly in the year that I have been regularly coming on these boards I have seen this come up a few times. Advertising has it's place on the boards, by following the 101 tab you can find what you need. The rules do state "Do not advertise competing websites, directly or indirectly, without prior approval". You are a competetor to Harry when it comes to supplies sales. You have and agreement that puts your add in what Harry has set as the right place on the boards. That is why it can be considered advertising. I think that the tip is great but should be shared by email.

SarahBeth - You are WELCOME !

And thanks for saying thanks. Smile Dan's a pretty smart man -- who knows what cool thing he's going to come up with next but if it has to do with being a more prudent notary public, I'm bettin' he's working out the details right now.
