NoBrs on TX docs.... help
I have done 100s of Nobrs signings for Ca property but I got one for a purchase in TX and although the loan is in his name and boths names are on the DOT, NOTHING (but a name aff.) is requiring her sig. In Ca, Nobrs would have to sign the escrow docs, DOT, TIL, and a few others but this is requiring nothing. Because it is a purchase I don't want to oversign it and have funding held up because of me and since it's the weekend, there is no one to ask. Can anyone help? For TX, does the Nobrs have to sign anything?

Don't practice law and start adding signature lines. Doc preparation is not your job. If the docs are not prepared correctly, that is the lender/TC's problem. By making a courtesy call and saying, "usually, I see the non-borrowing spouse required to sign several docs - are the docs I got correct?" you are being professional and going over the call of duty, which I'm sure the company will appreciate. If you can't reach anyone (look through the docs and see if there is a cell or after-hours number for anyone at lender or TC), have everything signed as it was given to you and perhaps call on Monday before dropping the docs. In stating 'required to sign' you simply mean that the name aff is the only one with her name preprinted on it. If her name is preprinted on a name affidavit odds are there is something additional she needs to sign. Unfortunately, I am not familiar with Texas. Is texas a state where the non-borrowing spouse usually signs certain items? Brendatx my be able to answer this one for you.
