Notary in MN
I am currently employed FT as an escrow closer in MN at a title company.
Can I do signing/notary closings on the side, if it's not during work hours? I never signed a non-compete, and it's not like I would be taking business away from them by doing this.
I would like to think that what I do during non-work hours is none of their business....
Opinions?

This has nothing to do with notary laws and everything to do with your relationship with your employer.
Can you legally perform notary acts outside of work? Absolutely.
However, a lot of companies (especially in financial, legal and other highly regulated industries) have "codes of conduct" that address outside business activities. You may be required to get OK from your boss or HR dept. to pursue a side business. There could definitely be a conflict of interest here. One thing to consider: Will you be answering calls from SS/TCs at work (on your cell phone of course, not your TC line)? If so, your boss might notice anyway and be upset if you didn't get proper approval.

Are you using your employer's e-mail addy for signings? If not, are you using your employer's computer to access your home e-mail addy? Bottom line, are you using your employer's printer, paper, toner for signings?

No, I would NOT be using any of their equipment or my work e-mail address. I don't have a manager in my office; if I were to take any calls from SS or TC it would be on my cell phone with my office door shut.... I guess what I'm really worried about is if they could sue me. It wouldn't really matter if they fired me since I plan on going independent anyway in the near future.

Thanks Sharon! I plan on going independent soon. I guess my main concern is if they could sue me for doing this after I leave. I want to get started with this now so that when I do go independent, I have some extra money coming in while I'm transitioning. I do have clients that will come with me when I leave the TC, but I would like to this as well.
