Signature by Mark,Trustee,POA Countrywide signing
Top this one! I need opinions please,yes I have searched and yes I have read comments about signature by mark, I have also followed page 11 in my Cali Notary Handbook. The question is, Mrs. Borrower had to sign by X this is how it looked
X Mrs. Borrower by Mrs.Borrower Daughter Mr. Witness
Countrywide is freaked because of the word "by" stating this shows the daugther is acting as POA (we are signing a POA) I say the daughter is signing BY Mrs. Borrowers Daughter showing she indeed signed as witness and wrote her mothers name by the X.
I have done a signature by mark like this in the past and it was not kicked back.
What do you think?

Calimn, the handbook doesn't state whether or not you should use the word "by". However, the handbook requires two witness', not one. Since it's not specified, they shouldn't have a problem with "by" and it doesn't mean POA, IMO.
Countrywide is wrong, but they are the lender. I'd copy the page of the handbook then fax to them to ease their fears. You are responsible for the ID, as notary, and Cwide should accept that. Still, I'd fax what the book says to appease them.
Sounds like you did this very responsibly. I hope you got two witness'.

it just looked weird in the post Mr. Witness signed below Mrs. Borrowers Daughter
