This feel off the message queue before most of you got to see it.

I want your opinion

Well, it must be normal. I had the same thing happen to me last night. The SS failed to send me all the documents. I agreed to go back out and have the documents signed but they wanted me to back date the documents which had to be notarized. I told them no and sent them information from the SOS website. I had an order for them tomorrow night but they cancelled it today. They said they would not use me anymore. I have emails from them, should I turn them in? I think I should. They are also one of those cheap SS here locally in the Denver market. I preferred not to work for them anyway. Maybe I should of caught it their mistake in the first place, but I had a Hud, just not the title documents. This is a lesson learned. Should I turn them in, Yes or No?

Yes. If you prefer not to work for them and they are not going to use you anyway. Basically they want you to commit fraud so that they can make money out of you.

Unless I am misunderstanding, you had all loan documents and were just missing the documents required for title insurance purposes, i.e. ALTA Statement, Survey Affidavit, Payoff Letters, etc. If this is the case, I would have asked them to call the title company to verify whether the documents even needed to be signed and acknowledged as of the date of loan signing. If you don't mind burning the bridge with the ss, call the title company yourself. I believe that most title companies would just ask that they be dated and acknowledged as of the date the documents are actually signed. It should not hold up the loan disbursement at all if completed in a timely manner.

It seems to me that the ss may have been attempting to cover up an error on their part. Asking you to back date just compounds their error. As to whether or not to turn the ss in to the SOS, let your conscience be your guide.

I believe that their request would have to have been put in writing.. If it was verbal then it would simply be your word against theirs.

I agree with Pat

Those title affidavits can be signed anytime before the RTC ends and the title company wouldn't care if you refused to backdate. They aren't recordables. SS probably forgot to send you the docs and are covering their butt.

If you have backdating request in writing (proof), turn them in!

Absolutely!!!! I agree with what Theresa said. If they have done it to you, most likely they have done it to others. And it needs to stop. Just my thought!

IF the emails specifically ask you to backdate the docs, then by all means report them. Make copies of everything and follow your conscience. Sounds like you've made up your mind.
