Contacting Title Co. About Non Payment?

I did a signing on 3/11 for an SS that is well known for not paying. (my bad...I didn't do the proper research in advance) I have resent invoices and called numerous times. I keep getting the runaround and assurances that I shoud receive payment within the week. (for several weeks in a row)

I am now ready to contact the title company and/or lender. The title company is American National and the lender is Countrywide. Does anybody have suggestions on the best way to proceed?

Approach?

I know I don't want to start off with them like they are to blame or I am threatening them. Should I begin my approach as a point of information or to ask them for intervention?

I was very polite, I told them I had completed a signing x time ago, I gave them loan number, name and all details. I have struggled to get paid by the signing service that hired me and apparently a company you endorse. I'm considering going to court on this and I would need to name your company since I sent the docs to you? I'm sorry to have to do this but I see no other way to recoup my cost.....

I feel that I express myself better verbally. But would a written communication be better for the paper trail? Or maybe a phone call with an e-mail confirmation/follow-up?

I would do what feels best for you, if you feel you will do better on the phone then I would do that. I personally love to write so I would always choose written words.

Thanks for letting me "pick your brain". I had a vague idea about how I wanted to procede and your input help me solidify my plan a bit more. I will be contacting the "proper authorities" on Monday.

I really think you should follow-up your phone call with an email or a fax, solidifying the conversation in writing.

It shows that you are serious and creates a paper trail. Remember, if it's not in writing, it never happened.

Yes, I agree with Tina MA, I document everything, most of us have so many things going on in our daily lives and I have a terrible memory when things get hectic. I write in detail anything of importance, I keep a spiral notebook on me 24-7, but that's just me. I can't tell you the times I ahve needed this spiral notebook to research a situation.
Also if anything changes in signing I e-mail the changes, request a response and update from their end even if the ss has an excellent rep, as Tina said if it's not in writing it didn't happen.

I made contact with Title Co. I asked if they were currently using ?? SS. They said yes. I asked (nicely) if they were aware that several SAs had not been paid by this SS? There response was no. I told of my efforts to collect being sure to state that I was aware they could not pay me direct since they had already paid the SS. I was simply letting them know of this issue and wondering if there were any contact they might be willing to make to help me get payment. They asked me to fax the confirmation sheet (which was my proof of correspondence with them). I received a call from SS the following day and payment three days later to include one from early 2005 that I had written off to bad debt.

Yes, Lulu, I gave the edited version of my situation with collecting from the title company but my situation was a 9 month ordeal from the time the signing occurred and I was paid. I never write anything off, I intend to collect one way or another, no matter how small the fee. I keep a file on every communication I make with the ss or title or anyone related to the signing.
I too with my first communication to title informed them I knew it was not their responsibility to pay me, title folks were always very nice. And in fact with title, I ask also if they were aware the ss had not paid several notaries, they informed me of the sob story ss boss had fed them, the difference, they believed it. I delicately shared with them and forwarding a few bits and pieces of information I had gathered along the way about the ss and the person that of course most on this board certainly knew his reputation 2 years ago.
All of my exchanges with title were always pleasant, professional and handled calmly on both ends. They were great.....but they too were taken by a fool and con artist.

It's too bad they didn't take you for your word.
I have to laugh. My experience was with, of course SOX. That Brandi! When I told her I faxed, she asked what number and said that is no longer in use. When I told her I had left several voice mails for her she said she didn't get them. When I rattle off the dates of those and the dates I emailed invoices to her she said she didn't get the emails. I said that is funny I still have the read receipts from those emails would you like me to tell you when those were read. She still insisted she had received no correspondence and in addition after working for them as far back as early 2005 she tried to tell me she couldn't even find my in their database. I told her she was unreal. Yes very pleasant, professional conversation with the title company and additionally with the person who called me back from SOX. It pays to keep all your back-up and think through the process to exercise whatever contact you need to get paid.
