I WISH TO CANCEL

Had a signing tonight that had been scheduled for tonight since LAST WEEK. Bwrs knew it was coming, knew witness requirements, etc.

I arrive & they have no witness. They start scrambling to find someone. Ok, not the end of the world. (Always have a backup plan -- know where the library is & when it closes, etc) I suggest that we can sign the documents that don't require the witness & save those for last. Bwrs still anxious (I can understand this) & keep looking out the window, distracted.

Bwr spots neighbor outside & flags him down. I pull the 2 whole documents that call for an additional witness. Bwrs sign, witness signs. I thank him, wish him a good evening. (Subtle, don't you think?) Well Mr. bwr starts getting into conversation that they just bought such & such, wants to drag out pictures, etc. Wife tries to tell him it's not time for that, witness states that he was out with the grill -- hasn't eaten yet (hint, hint). Mr. bwr still converses. I turn to Mrs. bwr & ask if we can continue. Mr. can catch up...

Mrs. bwr signs the next few docs before we get to the RTC. meanwhile Mr. bwr comes back to the table -- ok, so subtle worked, right? I get Mrs. bwr started on the RTC -- show her where to complete, she starts completing in correct spot. I turn to Mr. bwr to give same directions about the form. I turn back around to Mrs. bwr & she's completed the correct section on each copy PLUS signed under the BIG, BOLD "I Wish to Cancel" words. I have no blank copies for her to do over correctly.

I take a breath, realizing that she has just cancelled the loan, and explain that she just signed that she wants to cancel. I say, "that's ok, we'll just use one of the copies". (Happens often enough to where I almost expect it -- usually I catch them as the pen is heading to the "forbidden zone" & I divert to the correct area) But, of course, she's completed all of them like that! Bwrs ask if they can use white out. I simply stated "no".

I immediately call SS to explain and I'm instructed to have Mrs. bwr line through & initial the correction. I also had Mrs. bwr attach a note on a post-it that the signature was in error. What do you want to bet...the whole thing will have to be re-done?

Bwrs are like children -- can't turn from them for a second -- LOL Anyway, that will teach me to lose control of a signing.

After that, Mrs bwr was practically throwing the docs at Mr. bwr to sign. Their first question after was "Then why is there a signature line on the form for that? Why can't someone just call a number if they want to cancel?" I didn't even answer...could have said it's a gov't form, I suppose, but it wouldn't have changed anything at that point.

I still wished them a nice weekend, though.

Why didn't you use the borrower copies? I find it helps to point to where the borrower is to sign on the RTC, explaining that the signature line above is to cancel.

Lynn, I think she had the Br's copies out to be signed with the originals, so all copies would be signed before she left. I will always separate these copies. Have Br's sign the originals first and have the Br's copies on top of the stack in there folder. Pull them out and after the originals are signed correctly I have them sign their copy. If they mess up the first ones then I leave them with them as their copy.

I still use (and probably always will !) the sticky arrows to point where they need to sign. I always put the arrow across the "I Wish To Cancel" line pointing at the correct line. They would have to remove the arrow to sign in the wrong place. Kind of a pain, but never miss a signature this way!

You are correct, I had placed the bank copy on top & given the instructions to only initial & date the very bottom section. I pointed to where that was & she did as instructed. Therefore, while she was doing the same on the copies, I turned to get Mr. brw up to speed. She took it upon herself to do additional signing on the RTC.

That is a good idea, (wish I'd thought of it) to keep the copies separate until the original is completed correctly. I usually will keep all the RTC's together in with the docs to be signed (especially w/edocs -- only a handful of companies include enough RTC's, even when printing bwrs copies). In almost 3 years, I've never had all the RTC's completed incorrectly like this. The first one, yes, people don't listen to instruction very well at times, but this was a new one on me. Lesson learned & that's why I post here -- for the great suggestions & process improvements!! Thanks, to all who respond to my yammerings!!

I leave the borrowers' copies of the RTC in their set of documents, unless I need them so they can each sign three copies. If there are three copies in the lender set of documents, there is no need to have the borrowers sign their copies as well.

As a former escrow officer and real estate paralegal, we NEVER had the borrowers sign their copies of the RTC. Their copies go in their copy package to be opened later at home. If you leave them alone in their copy package, there is no chance that they will get gung ho and sign everything in the wrong place, and that way if a mistake is made, then you pull out their copies and use them.

Another suggestion, is that I leave my email on my server for 10 days. If I am at a borrowers home, and I need a copy because they mis signed something twice, I can access my email via webmail and just print the doc on the borrowers computer.

While most borrowers have a computer and printer, it is unlikely that they will have legal size paper. Do you keep some in your car?

Sorry I missed all this last night! I thought Melissa's post was a "comedy of errors" that she was sharing with all of us which resulted in some logical suggestions, except for your last msg. Sounds kinda "drippy".

This is the only form in the package I put the little sticky arrows "sign here" on.
In my experience, since I started doing this with the NORTC I have had no problems with the brws signing in the wrong spot.

Are you referring to my message as "kind of drippy"? If so, I don't get it. I was asking NCLisa if she carries legal size paper in her car, as she wrote:

BTW, NCLisa did respond that she carries legal size paper in her car.

I have a ream of letter and legal in my car. If push comes to shove, and I'm out of legal, or the dog chewed it up, shrinking the doc to fit on letter is an option.

The first time this happened to me I just pulled from the borrower's set. Now I always try to keep extras with me. They stay in a folder with my loose certs. I've never had to use any of them but if there's one thing I've learned from this board it's to always be prepared fo the unexpected because anything can happen out there.

WHITE OUT? Looks like these borrowers don't realise that these docs are a legally-binding contract.
