SS asking to back dates documents...

I was suppose to do a closing on friday...however the SS never faxed or email the confirmatiin sheet. I had no phone number on them since on the caller ID it clearly said "private caller". I specifically told her to email me the confirmation but she insist in faxing it. well...one thing I've learned, not to trust my fax machine. I never ever got the fax. So I had no way contacting the borrower or the SS or the TC. So when the time came...I was already to leave the house, and waited to see if they called if I didnt show. It was not that I was intentionally not showing up...I just didnt have the info to get there. But I was ready to run out the door. So I assumed that the borrower would call his /her broker or the lender and they would call to see what would happen, etc...so I waited for the call. Nothing.

well..this afternoon she calls and ask why i didnt show and I explained to her that i never got the fax or/and the email and I sat here waiting for someone to call when I didnt show so I can get the info. I told her i didnt have their number to be sure. I had to assume that the closing was cancelled when I didnt hear anything or the fax. She asked me to go and to back date the docs to Friday. I said no...that is against the law and don't ask me to break the law...that would make it fraud. And then she had the nerve to tell me that she is going to find a notary who will back date it. and I told her she can't do that that would be fraud and she hung up on me.

Now...I know I was stupid enough not to ask for the SS # the first time..that I will take responsibility for. But if the borrower waits till today to complain and not the day of the closing then what was I suppose to do. If the SS had emailed the confirmation as i asked to do, then maybe none of this would not had happened. However, I am NOT taking the full responsible of it. She should had confirmed I recvd the fax. I dont know what it is with my fax machine but my sister get s confirmation that she faxes stuff to me but i never get it at all.

If people are trying to fax things to me while I'm on the phone, it will not come through. But i was not on the phone when she did try to fax it to me. I waited and waited. ..& waited.

When SS's ask you to back date documents for the sake of money and not the sake of legalisation (sp?) then you know fraud is involved. And I for one will NOT committ fraud for a company that has not ethics.

Was I in the wrong or was this just a simple miscommunications/misunderstand? This is the first time this has ever happened to me. I never had this issue before (of course there is the first).

How would you had handled it or how have you handled it?

You need to get maxemail or efax--you will never loose a fax again. Even though you told the scheduler you wanted email, they sometimes sidetracked.

A reliable fax, like extra toner and paper, is ESSENTiAL to be successful and reliable.

You did the right thing by not backdating, but I would personally refrain from reminding the scheduler that it is illegal to find a backdating notary. You may have squandered future assignments from this company. You never know, maybe the scheduler was trying to cover their fanny and asked you to backdate. It does not necessarily mean the signing company approves of backdating. Always keep the door open.

I dont understand why a SS,lender,LO or anybody else hide their caller id. This is the first
sign that a SS,lender, LO or anybody else is hiding something. If I am doing business, I want
to give my phone number to the person I am doing business with. I only do *67 when I called
SS that are behind in my payments. In your case if the SS woud showed the number in your
calling id, that will resolve the issue.

Efax or Maxemail is the way to go for the serious signing these days IMHO. Also, try UREACH.com.

You have 'em and that's thats. You can set things up to be stored even.

Too tight to pay? Go with k7.net - just get something that is not free floating paper.

is nothing to do now?!?! The first thing you should do is get a fax machine that works, if this and it clearly has been by your post an issue in the past, fix it, would be my suggestion or simply tell the ss you have no fax one or the other....
Backdate- A given, NO CAN DO!
SS- NO NEED TO WORRY THEY PROBABLY WON'T BE CALLING AGAIN.
Phones Calls- When the ss calls, get name of company and phone number, critical to your business at all times.
According to your post- they most likely did fax this work order to you, had you had the number you could called them back (very important in business) to have all the correct data.
On a personal note it almost sounds as if you feel a bit guilty, is there a reason for this?
Bottom line, you have learned a lesson, gain from this experience. Don't allow it to happen again you are in control.....

No! but thank you for the offer. I was checking the internet and I found out that there is
now refill kits available for our printers. Its not cheap, its at 25.00 dollars for 250 grams of
toner for the TN-580.

guilty....guilty that for the first time i screwed up on such a simple little thing. I could had used the money, so it wasnt a money issue. Guilty cuz i failed to get the companies number to do my job professionally and accurately in communications. It clearly was a big "misunderstanding" or miscommunication and perhaps on my side, but more on their side.

I was just shock the borrowers didnt say anything to the lender until today. Not Friday. I sat there,d ressed ready to run out the door. I just needed their number and address to go to.

perhaps now i know why some SS's has our do call backs to confirm the receipt of the confirmation and borrowers time.

I probably would've gone out to do the signing w/o the confirmation, and handled it Mon AM.
I would've let them know when they called that I hadn't received the confirmation and couldn't send the executed package until I did.
Additonally, I'd have looked through the 1003 and called the brw to confirm the appt.
If you look at the HUD, you can get the TC's name and address, sometimes phone numbers.
Consider e-fax or one of the other electronic fax companies, or get a dedicated fax line.
(Up to 20 pages/mo. free w/ a free efax acct.) You should always have the fax number available to companies!
Additonally, any hiring party that calls me with a "private" number is suspicious to me.
I'd have asked for their contact information before accepting the assignment. (could've been SOX for all you know).
There is a high level of non-communication with many SS's.
That is why I'd go to all lengths to acquire the brw's information/TC's information before I decided to no-show. (They'll know if has been cancelled)
It has happened to me before, but I never no-showed. I've even gotten a "bonus" from the
SS when they realized they dropped the ball on me, but I am not sure that is what happened in this situation.
At least I'd have gone to the appt. and have complained to the hiring party if the brw was a no-show, and have collected a travel and printing fee, becsue it would be their responsibilty to notify you of the cancellation.
Backdating is illegal, and I'd never do it for anyone, not even if I was the one who messed up.

only that this was overnight docs and it was sent to the borrower, so I had NOTHING on them at all. If I had the docs emailed to me then it would not had been so bad and I would then happy to go.

I admit my error was not at the beginning obtaining the number from the SS...however all Ihad was on the board ...nothing more. so now...I'm using a form and hope i dont waste paper and ink.

My fax machine is only a year old...but I'm going to see why it is doing what it does. it is one of those all in one machines. I dont want to have anymore extra expenses more then I need to...as it is, I'm trying to save on a new printer that has two trays.

I will look into the efax but I think I had it before this machine and it was screwing me over so that is why I got this machine (was actually donated brand new from a friend).

O/N docs are different

Since you have no way of contacting ANYONE, I don't see how you could've done anything different (except for the acqusition of contact info at the acceptance of the assignment).
Live and learn, right? Chalk this one up to experience.
(BTW, my efax acct. is only $12.95 per month, up to 200 pages: some other co.s are less-it is worth it's weight in gold for me, and I am saving for a new laptop)

I use k7 -- it's free, I can access from any computer & save faxes as well. Definitely worth a look anyway. Another tip is to try to get the bwr's phone number from the scheduler so you can call to confirm while you're waiting for the confirmation to come across.

My dad bought me a used Dell GX150 from Pratt & Whitney for Christmas (he got my son a laptop from the same). (They have a store that sells the used equipment periodically. The HD is erased & comes pre-loaded with Windows 2000.) It's pretty bare-bones, but I'm in the process of upgrading memory to max & have downloaded the necessary programs to run on it. Currently, it's my backup computer, but I'm switching over from my "old" one to the "new" one this year. It only cost $80 -- the laptop was a bit more. It may be a lower-cost option for replacement than brand-spanking new.

You don't say if your fax is a stand alone, or an All-In-One connected to your computer. If it's the latter, you might need to adjust your settings so faxs are sent directly to your printer and not the log file. jat

Get eFax, MaxEmail or some other fax to email service and

you won't have this problem in the future. Use your fax machine to send faxes only.

Dee, try K7.net. It will come straight into your computer and will show up in your e-mail as a K7.net message. It works great and you don't have to worry about being on the phone. It works just like e-mail. They even give you a special fax number. Just my 2 cents. Maybe it will help.
