Yet another Payment question
OK,
I was wondering what you all think of this. I get a call, very last minute to do a closing about 40 miles from me. I rejected at first, but called back and took it because I am a nice guy after all and they quoted a really good price.
I did the closing. Two weeks later, I get a call from a manager at the signing company, and she tells me that the borrower "undersigned" the entire package (didnt use middle initial) and the RTC was not dated correctly. Well, I have done a bunch of RTC's in my life and can't imagine getting it wrong.
Anyway, this woman tells me that thier lender didnt pay them because of the mistakes, so they dont pay me. I told her they should, and that I would have driven back to correct any mistakes if they had told me earlier. She said she would talk to "upper management."
Incidentally, this company is Loan closers.com, and they dont exactly have the best reputation here on the boards. (Thank God for these boards.) Also, thier independent contractor agreement doesnt list any penalties for missigning.
So do you guys think I am entitled to be paid or not?

Well I know if it were me
the very thought that I would have missed the RTC dates AND allowed the bo's to undersign would drive me nuts. Not that it hasn't happened to all of us at one time or another, it's just I think I'd want to see it to believe it. Since that won't happen...I wouldn't be able to rest until I looked into this....knowing me I would probably call bo's myself and ask them if there had been a resign or if LO had to fax any "additional" docs that may have not been with the original package. Somehow I'd figure out a way to verify what I had been told. As far as being "entitled" to my fees, I strongly feel that if I make a mistake I'll go out and get it fixed, my dime. Yes, I definitely feel that IF this happened they should have allowed you get get it fixed, your dime BUT you're still owed your fees. They didn't even give you the chance....something smells...sniff sniff...TWO WEEKS? HUH? Go get em!

The reputation of the company is definitly an issue. What if I did make those errors? Do you think they still owe me?

Brenda expressed things beautifully there and taught us all a lesson with her humility. However I think what Brian is saying (or at least the way I'm reading) is that 2 weeks later the SS is coming back telling him such and such without giving him an opportunity to fix it. Brenda and the others that posted along with her knew within one or two days that they had a problem and fixed it on their dime....certainly not 2 weeks later. Or am I just tired and not reading things correctly....or too old....or or or......~smiles~

When I was in management
one of the things I hated to do the most was point out errors to the people I worked with. Things are alot different in this type of work, big money is on the table and huge losses can happen because of something we've missed. Having said that my gut reaction here is that perhaps this isn't the case...why would it take 2 weeks to discover this? Seems to me Title would be all over the SS wanting to get things corrected. For that reason I'm thinking to heck with them, they owe me and they're going to pay me UNLESS they can show me proof of what they're accusing me of. Otherwise every SS in the country is going to pull this shady type of payment avoidance and none of us will be protected. I would stand strong, how do you know what the SS is telling you is truth?

If they could prove to me that a re-sign was necessary due to an error of mine, I would drop it and not expect payment. After all, they had to pay someone else to fix it (although I, too, would prefer the opportunity to make it right, on my dime). However, like Sue, I would want to see a fax of something showing my error. If there was something else going on and I was sure I did my job right, I expect to be paid. We all need to stand behind our work and take responsibility if we make a mistake.

I haven't read any of the other posts but my first response is for them to fax you a copy of what they say you did wrong, otherwise you will expect full payment.
I'll read more now.
