deeds changed at closing
i signed a statutory warranty deed on my husbands refinance and when the papers came in the mail i saw the form had been changed with white-out to a quit claim deed. i kept the form because i thought it was very suspicious and now that my husband has filed for a divorce he claims that i had signed off of our home 2 years ago. I would never sign off of our home and now I am in the process of seaching for the notary because she can not be found. I have many questions about what how this could occur when I also signed on the deed, and the truth in lending statement. What can I do to prove that I would never sign a Quit Claim Deed?? Our home is now worth over 800k and I am in the rental home that was my home prior to marriage. He claims that we both has seperate estates but I didn't get a Quit Claim from him. frantic in washington

You need to talk to an attorney. The secretary of state can help you find the notary.

Just want to let you know, because it doesn't appear that you are a notary, that SoS stands for Secretary of State. Sometimes we forget that not everyone understands our "lingo". ; D

Sorry Lisa! My Bad! I realized after I posted that you might think that I was responding to your post. You clearly stated "Secretary of State". I was just thinking if a non-notary was doing a search, they might wonder what SoS stood for, which is in many of our posts. I knew what I meant, but was afraid others might not. ; D
Also, a note to the original poster. If you have a document that was obviously whited-out, you have a huge smoking gun in your favor. It shouldn't be too hard to track down the notary involved. Best wishes and GOOD LUCK to you!

Anon...no one here can answer your question. Yours is a legal issue, and must be addressed by legal professionals.
The notary issue you mentioned is but a tiny part of the bigger picture. Get an attorney, now.

You need an attorney - how do you think the notary can help you? We don't practice law and most of us don't keep copies of what we notarize.

you signed a warranty deed. How is it the notary's fault that it was changed to a QCD? Actually, it's better to sign a qcd as you are not guaranteeing clear title. Get a lawyer--this is probably a fake question.

thank you so much for recommending that web site. It's awesome and so helpful. I just wish I would have read it before I forced him into counselling and all of things that I didn't understand. It's all so very clear now and I am just very happy to know that male midlife crisis is real. He was divorced after 2o years of marriage and I guess I must have been rebound girl because I was the second woman he had been with in his life. He should have sown his oats when he was single for 10 months. We were together for 6 years, married only 2. He came home one day and said he wasn't happy and wanted a divorce. I was floored, hired a p.i. and he was sleeping with an employee-married employee. Her husband is in the military. I was just so stupid to not see it. I think that she just saw everything that we have aquired it wasn't him!!! What he doesn't realize is Washington State is a community propery state and there was no prenuptual on the business, so he is in for a very rude awakening. (like his crisis will cost him about 1M$) When I met him he was -50K$ after his divorce and I just loved him, so he's really stupid to think the women out there now are going to just fall in love with him, I'm telling you, they see what we have. The day after I moved out of the house, the other woman and her 5 year old daughter moved in. It was sick!!! But at least now, after reading the midlife crisis forum, I feel good about me, and that I couldn't have done anything more for him, or our relationship. Thank you again
