I'm in Ca. when signing a DOT I am not the witness because Ca. is a non-witness state and borrwers would only need a to have a witness if LO suggest .....I'm confused..............I only notarize Rigghhht???

Notarize the DOT. CA is not a witness state and as a CA notary you follow CA notarial law no matter where the property is.

The witnesses have nothing to do with notarial law, it is the recording laws. If the propery is in Florida, even if you are notarizing in CA you would still need to have a Deed - such as a QCD or WD or GD etc witnessed or it wouldn't record. It pays to have a list of witness states. (It is really up to the company to let you know that you need witnesses though)

Unless specifically asked you do not need witnesses. However, if the lender is requesting witnesses it is up to the borrower to provide them.

I am confused by this as well. I have tried searching this and other forums, google, yahoo, etc. etc.(to the point that my eyes are burning and blood shot), but am coming up empty handed on a good description of what "witness state" means exactly. I am not in a witness state, but I'm not sure what that means to me. . .
Can anyone refer me to a site or shed some (additional) light on this for me?

Thanks Becca! That helps tremendously! I think that I am confused because as a part of my quest for the answer I looked at deeds on the County Recorder of Deeds web-site and most of them did have witnesses (that were not the notary). A few did not (actually, my deed was one of them!). That is the part that I don't get. . .
