I don't require, I make a note of it myself and I keep a register for all my invoices.

Reg Journal? "Do the borrowers have to sign my journal?" It may not be required in your state, I don't know, but if you are making a journal entry why not have them sign? This deters fraud as does the thumbprint. It's a judgment call on your part if not a requirement in your state but I wouldn't do it any other way.

The reason Texas removed the signature requirement is because the journal is a public record...some people do not want a page with the signature to be distributed upon request.
Go figger...not my rule...just passing along what I heard in the judicial committee session of the legislature.

Interesting point. In CA, any member of the public can request a copy of a journal entry, but only if they can provide a written request to the notary with the name of the parties, the type of document, and the month and year in which the doc was signed. Hopefully this makes it difficult enough to avoid fishing expeditions.... but I guess you never know to what lengths some people will stoop! (We are also required to keep all journals locked up at all times, under our own exclusive control.)

Just a thought -- the recordable deed is public record & contains the borrower's signature...I guess the difference is the manner of identifying the signer is listed in the journal. Then again, cashiers write the DL info right on a check, so that isn't all that private, either.
Although CT doesn't require a journal (it is highly recommended) & always have bwrs sign & I request a thumbprint "to guard against identiry theft and mortgage fraud". However, like PAW noted about FL, I can't legall require a signer to provide the print, nor can I refuse to notarize a legal request based on not providing the print. It may, however, cause me to request additional ID, if I have any doubts aside from the print refusal.

I agree LuLu, this post got me wondering so I double checked and while a journal is mandatory in my state, getting signatures in the journal is merely "highly recommended". I've always had my borrowers sign and never had a problem. It helps me in my identification process and I've never had a borrower refuse.

Something else I do to ease the minds of the borrowers regarding security of having their info in my journal: I have cut different sized card stock strips. All previous entries on that page are covered. I do this to protect the security of the signers information and hope it lends to signers being more confident in me, that I am conscientious to cover previous signers info from prying eyes.

This is a great idea, I think I have in the past just thought the borrower felt overwhelmed at the moment and didn't bother scanning the signatures above them but I think I will indeed incorporate this privacy screen for borrowers....Good Tip....thanks

A journal is not kept in our state, but being a former CA notary, I keep one, require everyone to sign. They recommend keeping a notary journal in NC, wish they'd make it a requirment.
