Borrower shouted at me on the street

I was late for a signing. Reason being borrower home located in a new housing community where streets were not marked properly. Being in a remote area, my T-Mobile cell phone was not working. When I reached borrowers place, they were standing at the door, they started yelling at me on the street and left the place in front of me without signing. Later they complained to the signing co. that I was late - Signing Co. stopped giving business - I am fine with that. But what are my legal rights against the borrower - and co borrower - both of whom were shouting at me on the street.

I don't think it's illegal to shout @ someone as long as

they weren't threatening or slandering you. I'm curious, what were they yelling?

Well, just chalk one up to experience. Sometimes things just go wrong. Hey, you were late and they probably had to be somewhere and were frustrated and unless they threatened you with bodilly harm, you have no where to go except let it go and apologize to the signing company.

A tip for the future. I service an area that is growing so fast, Google Maps, Yahoo maps and the GPS software is as much as 2 years behind in getting new areas mapped. I run the maps and always make sure I mention cross streets to the borrowors when I make contact before the appointment when I am going to one of those areas. I allow plenty of time as the correct time to show up to an appointment is 15 minutes early. And T-Mobile is probably not the best in any area .....

How do other people feel about the statement ...

... "the correct time to show up to an appointment is 15 minutes early."?

I disagree. The correct time to show up for a SIGNING is the appointed time. No earlier, no later.

For a job interview, on the other hand, ten minutes early used to be the rule.

Agree, Ernest ...

I just find a spot nearby and park, and hit their door precisely on time. I'm generally 15 min early - so I read mail, make phone calls, etc. I have a life-long 'thing' about being on time for everything.

Renee' - Punctuality separates the women from the girls!

And, if you are riding a moped, you have to add a little extra time factor in there...especially in traffic hours.

(This *Punctuality separates the women from the girls!* seems to make more sense the longer I look at it. Try meeting a younger woman for lunch! I did yesterday and she was 20 min late due to loss of keys...then there's bad hair, a minute wrinkle in one's clothes...I remember a few of those myself.)

Brenda, you may likely relate to this...

Having been raised with Southern manners, it's considered one of the greatest insults to arrive late. There is no such thing as "fashionably late" in the South. If you are late, you are rude and inconsiderate (and may, on occassion, miss dinner!)
This isn't to say that Renee or any of our other fine Yankee friends, consider lateness any less rude. But punctuality is stressed in a G.R.I.T.S. upbringing Smile

ahhh...well, I live here now and I respect the Southern values. I found it strange at first that girls over 20 still say Daddy. Or the waving when you drive down the street or while pumping gas.
Being from the Midwest, yes I was taught values as well on punctuality and manners but, I was thinking to myself when someone waved at....Do I know him???
I will say that when I go home, it's an eating orgy, I'm still trying to adjust to that way of living. Smile

Yep Charm it's a different world in the South

The waving, oh the waving. Lots of that going on. Especially on out street. Only one way in or out. It doesn't matter who drives by you always wave. One of our realtors knew everyone in town. She drove by and everyone waved then she would say "that's so and so". We stopped for a soda and within 2 minutes 3 men walked up and said hello to her.

Hi Lisa: A minor correction if you please....

Being a Yankee myself I'd like to bring to your attention that the only Yankees are those people who come from Maine, New Hapshire, Vermont, Massachussetts, Conncecticut and Rhode Island. That is Yankees are people from New England. Mark Twain started the mis-identification with one of his books "A Yankee in King Arthurs Court" while I understand the desire of many to be considered Yankees (particularly NewYawkas) we Yankees thake this whole situation quite seriously. Anyway that is what I have been told Smile by those of long-term Yankee descent.

**Southerners refer to anyone residing North of the Mason-Dixon line as a Yankee ;-)**

Or, if you are in Texas, the cut-off is at Waco...100 miles north of here.

If you are in South Brazoria County (Texas Coast) Yankees are at the south edge of Houston.

Basically, anyone north of your own county line...LOL.

Depends on where you are

Yes, Yankees are New Englanders, however, Southerns view anyone from North of the Mason-Dixon Line to be YANKEES (Can you smell it??? LOL) and people from every other country in the world view ALL of us as Yankees (and yes, they can really make it smell -- NOT LOL!).

I agree with Glen. Shouting isn't a crime unless it is slanderous or verbally threatening.
I had a borrower throw done the pen, stand up, and throw a real temper trantrum a few weeks ago! I felt like I was dealing with a 2 yr old. It took me about 20 minutes to calm him down. Geez!
For some people, re-fi'ing is VERY stressful, and we don't know the entire story of WHY or how.And just as we are often on a tight schedule, often times the borrower is, too.
Did you call the company that hired you and explain your situation? Often times a call to explain the problem rectifies everything. If I have a problem borrower, I call the co. that hired me ASAP and explain what happened. Most companies are willing to work with us, as we are the "face" at the borrowers homes.

This must be my week to buck convention ...

My first thought - HOW late were you?! There's too many details missing in this story. If you were less than 15 min late, well - they perhaps behaved inappropriately. If my cell didn't work, and I was going to be late at ALL, I would FIND a phone. Pay phones are getting sparse, but they do still exist.

The other thing I don't understand is why you're so snagged that you'd even think about legal recourse? I wonder if that's the same thing the borrower's are thinking about you, for being late. The things people want to sue people over is just over the top anymore.

Your legal rights are the ...

1. the right to be on time
2. the right to make a phone call if you are going to be more than 15 minutes late
3. the right to give a Bronx cheer if the borrowers are the being the horses patooey

I always get specific directions when I call the borrowers. It makes my life alot easier especially since it gets dark so early now. If the house is in a easy to find area I am familiar with, I plan to arrive 5 minutes early and wait in my car. If it is in an area I am unfamiliar with or in the country I give myself an extra 15 minutes in case I get lost. Just last night the borrowers house had an address of the main street but their house was way up a dark easement. I never would have found it without specific directions. I do wait until the appointment time to go to their door. It was unfortunate you got yelled at for being late. I think if I was more then 10 minutes late I also would have been looking for a pay phone if my cell did not work. I have Verizon and have had no problems at all but that is for my area. I also agree with the others that you probably really do not have any legal action unless they threated you.

I generally try to do the same thing as you. This reminds me of a situation I had recently where I was going to a new area and had a last minute appointment without the opportunity to get to a computer and print directions, as I usually do. I got specific instructions from the husband, but was having a heck of a time following them. I couldn't even find the street that was supposed to be my first turn from the main drag. I pulled out my newish Thomas Guide - which DID cover the area. The street he wanted me to turn onto didn't intersect with the main drag at all - not on the map OR the three times I drove by looking for it. I took a turn on a street he hadn't mentioned and eventually got to the street he told me to turn onto. The next turn was completely wrong, too.

I should add that I DID have cell phone reception and had him on the phone for most of this time trying to get him to tell me where to turn. I would tell him where I was, and he kept telling me what street to find next, but nothing he was telling me matched up at all with what I was seeing. (And I'm usually pretty good at directions.)

FINALLY, he offered to get his wife on the phone. Her first comment was "He's hopeless with directions!" At that point, I thought that was the understatement of the century... With her help, I was there in five minutes - but her hubby had me driving around in circles. I wonder how that man finds his way home!! I'm glad they weren't rushing off somewhere because that was one appointment I did not make on time. I was beginning to think someone had planted a camera in my car and that I was on the latest version of "Candid Camera"!! Smile
